On July 31, 2017 the Division of Hotels and Restaurants received a Petition for a Routine Variance for Paragraph 61C-4.010(7) Florida Administrative Code and Paragraph 61C-4.010(6), Florida Administrative Code from Lila Catering Corp. located in Miami. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers. They are requesting to share the bathrooms located within a nearby establishment under a different ownership for use by customers only.
The Petition for this variance was published in Vol. 43/148 on August 1, 2017. The Order for this Petition was signed and approved on August 17, 2017. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the bathrooms located within Alani Café Corp. (4315 NW 7 St Suite 30 Miami, FL 33126), are maintained in a clean and sanitary manner and are provided with cold running water under pressure, soap, approved hand drying devices, and are available during all hours of operation. The Petitioner shall also ensure that directional signage is installed within or outside the establishment clearly stating the location of the bathrooms. If the ownership of Lila Catering Corp. and/or Alani Café Corp. changes, an updated signed agreement for use of the bathroom facilities will be required immediately.

On August 4, 2017 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from Point Pizza LLC located in Coral Springs. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink and the three compartment sink.
The Petition for this variance was published in Vol. 43/152 on August 7, 2017. The Order for this Petition was signed and approved on August 17, 2017. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the handwash sink and the three compartment sink is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash sink and the three compartment sink is provided with hot and cold running water under pressure, and that the handwash sink is provided with soap, an approved hand drying device and a handwashing sign.

On July 5, 2017, the Department of Health issued an order in response to a petition for a variance filed on March 10, 2017, by Johnny Velasco, REHS, CP-FS, representing Advanced Fresh Concepts Franchise Corp., regarding the "Sushi Rice and Raw Animal Products". Petitioner sought a variance from Rule subsections 64E-11.004(2) and (8), Florida Administrative Code, which requires all potentially hazardous foods to be kept at 41 degrees Fahrenheit or below or 140 degrees Fahrenheit or above, except during necessary periods of preparation and storage, as well as, raw fish and seafood products be cooked to an internal temperature of 145 degrees Fahrenheit or above for at least 15 seconds. Notice of the petition was published in the March 24, 2017, edition of the Florida Administrative Register.
The Department found that the Petitioner demonstrated that the underlying intent of the statute could be achieved by alternative means and that strict application of the rules would create a substantial hardship in the Petitioner's particular circumstance. Therefore, pursuant to the requirements of section 120.542(2), Florida Statutes, the Department GRANTED W/CONDITIONS Petitioner's request for a variance.

Regency Palms Condominium, license number 104087, located at 5065 Royal Palms Way, New Port Richey, FL 34652 (VW2017-102) and a petition for Regency Palms Condominiums, license number 105584, located at 5089 Royal Palms Way, New Port Richey, FL 34652 (VW2017-101). License number 105584 is issued to Royal Palms Way, not Regency Palm Condominiums and will herein be referred to as Royal Palms Way. For both petitions, Petitioner sought an emergency variance of the requirements of ASME A17.1b-2009, Sections 2.2.2.5, 3.27.4, 5.2.1.2, and 5.2.2.14, as adopted by 61C-5.001(1), Florida Administrative Code, due to the elevators being manufactured to a newer code, which poses a significant economic/financial hardship.

Project Description: Project Development and Environment (PD&E) Studies
I-95 at SR 804/Boynton Beach Boulevard Interchange and I-95 at Gateway Boulevard Interchange in Palm Beach County
A PD&E study is FDOT’s process to evaluate the social, economic and environmental impacts associated with a planned transportation improvement project. The purpose of this project is to enhance overall traffic operations at the existing interchanges of I-95 at Boynton Beach Boulevard and I-95 at Gateway Boulevard, by providing improvements to achieve acceptable traffic levels in the future, within the study limits.
The environmental review, consultation, and other actions required by applicable federal environmental laws for this project are being, or have been, carried out by the Florida Department of Transportation (FDOT) pursuant to 23 U.S.C. 327 and a Memorandum of Understanding dated December 14, 2016 and executed by the Federal Highway Administration and FDOT.
The Public Hearing will begin at 5:30 p.m. as an open house. A formal presentation will begin at 6 p.m., followed by a comment period. Persons wishing to submit written statements or other exhibits, in place of or in addition to oral statements, may do so at the hearing or by sending them to Mr. Thuc H. Le, PE, FDOT Project Manager, 3400 West Commercial Boulevard, Fort Lauderdale, FL 33309. All exhibits or statements postmarked on or before September 8, 2017, will become part of the Public Hearing record. In the event the Public Hearing cannot be held on August 29, 2017, due to severe weather or other unforeseen conditions, it will be held on the alternate date of Tuesday, September 5, 2017, at the same time and place.

The quantities reflect the immediate and foreseeable needs of transit agencies within Florida and were determined by using the most recent State of Florida Program of Projects, historical data from previous Florida Department of Transportation contracts, Agency(s) requests, and Agency(s) vehicle replacement schedules. All or part of the quantity of vehicles stated herein may be assigned to other public transit agencies desiring to purchase the same equipment specified in Part 2 of this solicitation. The TRIPS program reserves the right to reject any and all proposals, or any part of any or all proposals.

Kenneth W. Lawson, O.D.,; The Notice of Petition for Declaratory Statement was published in Volume 40, No. 123, of the June 27, 2017, Florida Administrative Register. The Petitioner sought the Board’s opinion on whether the following activities would be deemed to be in violation of cited optometry statutes and rule: (a) becoming an owner of a vision care network company co-owned by laypersons; and (b) contracting with a vision care network company not owned by a licensed optometrist to render optometry covered services to members of HMOs contracted with the network. The Board considered the Petition at its meeting held on July 19, 2017, in Lake Buena Vista, Florida. The Board’s Order was filed on August 4, 2017. The Petition filed in this cause is in substantial compliance with the provisions of Section 120.565, F.S., and Rule 28-105.0022, F.S. Based upon the facts contained in the Petition and the testimony of Petitioner, the Board has determined that the operation of a vision care network company does not constitute the practice of optometry, and there is no prohibition on a licensed optometrist taking an ownership interest in a vision care network company co-owned with persons not licensed to practice optometry.
