The purpose of the amendment to Rule 59G-4.330, Florida Administrative Code (F.A.C.), is to clarify policy language. The amendment updates the Florida Medicaid Non-Emergency Transportation Services Coverage Policy,__________ to specify that transportation network companies are eligible to render Florida Medicaid non-emergency transportation services.

The purpose of these rules is to provide for the further conservation of blackfin tuna by implementing species-specific regulations that will be found in 68B-62, Florida Administrative Code (F.A.C.).
The effect of these rules will be to implement recreational bag and vessels limit for blackfin tuna. The rules will also extend the Florida Fish and Wildlife Conservation Commission’s (Commission) proposed blackfin tuna regulations into federal waters off Florida.

The purpose of this amendment is to provide clarification and update the regulations regarding freshwater fishing tournaments. The effect of the proposed amendment will be to allow the Commission to better serve fishing clubs statewide and improve access to the online permitting system.

The Florida Fish and Wildlife Conservation Commission (Commission) is considering changes to state shark regulations based on a requirement by the Atlantic States Marine Fisheries Commission (ASMFC) and recent federal changes. The purpose of these rule amendments is to increase the recreational shortfin mako size limit from 54 to 83 inches fork length and clarify that commercial harvest is prohibited in state waters.
ASMFC recently adopted a requirement for states, including Florida, to increase recreational minimum size limits for shortfin mako sharks to match the federal size limit, or to implement an equivalent conservation measure, by Jan. 1, 2020. To meet ASMFC’s requirement, this rule amendment would increase the shortfin mako recreational minimum size limit from 54 to 83 inches FL. To commercially harvest sharks in state waters, all commercial vessels must have a federal shark limited-access permit and the only allowable gear type is hook and line. Under federal regulations, commercial harvest of shortfin mako is only allowed when the shark is brought to the boat dead in the longline or gillnet fishery. Because those gear are prohibited in state waters, and because all commercial vessels must have the federal limited-access permit, no commercial harvest of shortfin mako is allowed in Florida state waters. Therefore, this rule amendment would clarify that commercial harvest of shortfin mako is prohibited in Florida state waters. Additionally, this rule amendment will also include minor, non-substantive technical changes to current rule language.
- Petitions and Dispositions Regarding Rule Variance or Waiver (2)

On August 7, 2019 the Division of Hotels and Restaurants received a Petition for a Routine Variance for Subparagraph 3-305.11(A)(2), 2009 FDA Food Code, Section 3-305.14, 2009 FDA Food Code, Section 6-202.15, 2009 FDA Food Code, Section 6-202.16, 2009 FDA Food Code, Paragraph 61C-4.010(1), Florida Administrative Code, and Paragraph 61C-4.010(6), Florida Administrative Code from Propana's Lunch Truck located in Orlando. The above referenced F.A.C. addresses the requirement for proper handling and dispensing of food. They are requesting to dispense bulk time/temperature control for safety foods from an open air mobile food dispensing vehicle.
The Petition for this variance was published in Vol. 45/154 on August 8, 2019. The Order for this Petition was signed and approved on August 26, 2019. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring that each pan within the steam table is properly covered with an individual lid; the steam table is enclosed within a cabinet with tight-fitting doors, and is protected by an air curtain installed and operated according to the manufacturer’s specifications that protects against flying vermin or other environmental contaminants; all steam table foods must be properly reheated for hot holding at approved commissaries and held hot at the proper minimum temperature per the parameters of the currently adopted FDA Food Code; and steam table food is to be dispensed by the operator with no customer self-service. The Petitioner shall also strictly adhere to the operating procedures and copies of the variance and operating procedures are to be present on the MFDV during all periods of operation.

On August 26, 2019 the Division issued an order. The Final Order was in response to a Petition for an emergency temporary Variance from Days Inn & Suites, filed August 2, 2019, and advertised on August 8, 2019 in Vol. 45, No.154, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 3.11.3, ASME A17.3, 1996 edition, as adopted by Rule 61C-5.001 Florida Administrative Code that requires upgrading the elevators fire fighter’s operation because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW 2019-149).

The Florida Department of Transportation (FDOT) will hold a public hearing for the proposed improvements to State Road 390 from State Road 77 to U.S. 231 in Bay County, Florida. The hearing will begin as an open house at 5:30 p.m. with a formal presentation at 6 p.m., followed by a public comment period. Maps, drawings, and other information will be on display. The Florida Department of Transportation (FDOT) invites all persons to an open house for the U.S. 1 Corridor Planning Study. The project limits are from Pineda Causeway (State Road (S.R.) 404) to Park Avenue, distance of about 9 miles. The corridor planning study process is evaluating both the short- and long-term transportation needs of the U.S. 1 corridor including intersection improvements, roadway widening, safety, and the addition of bicyclist and pedestrian features.
The open house will be 5:30 p.m. to 7 p.m. on Thursday, September 19, 2019, at the City of Rockledge Council Chambers located at 1600 Huntington Lane, Rockledge, FL 32955. It is being held to introduce the study and to obtain stakeholder input. Attendees will have an opportunity to view project information.
