The Petitioner, however, resubmitted his request without the designation “emergency” with the request that it be heard at the next regularly scheduled Commission Business Agenda Meeting. The rule requires candidates to become employed within four years of beginning a basic recruit training course. The Petitioner wishes to be granted enough time to attend and complete the next orientation training given by the Polk County Sheriff’s Office in November. The Petitioner has completed all other required steps in the hiring process for the Polk County Sheriff’s Office. The Petitioner began basic recruit training on August 10, 2009, therefore his four years to become employed, expired August 10, 2013. The Petitioner asserts that he in the final staged of employment screening with the Polk County Sheriff’s Office and that the application of the rule to his situation would cause him an undue hardship and be violative of the principles of fairness.

Rule No. 61A-1.006(3) defines, the term “package store” as a licensed place of business where alcoholic beverages are sold in the original sealed containers as received from the distributor for consumption off the premises only. The Petitioner expresses substantial hardship due to the requirement of increased licensing fees and expenses relating to upgrading to a COP license.

Tampa Bay Black Business Investment Corporation; The Department issued a declaratory statement applying section 288.7102, Florida Statutes, to the set of circumstances raised by TBBBIC in their petition and determined 1) TBBBIC is required to provide the Department with restated financial statements or any resulting clarification letters and addendums to its prior financial statements because they were incomplete upon prior submission; 2) TBBBIC must classify as restricted State funds all appropriated funds loaned by and repaid to them under the Black Business Loan Program; and 3) TBBBIC is entitled to a reasonable profit under the Black Business Loan Program as a component of the direct administrative costs, which are limited to the 12 percent authorized by section 288.7102(8)(c), Florida Statutes, and TBBBIC may not retain late fees, collection fees, and interest charges as its reasonable profit. The final order was filed on August 27, 2013 and assigned Final Order No. DEO-13-085.
