On June 27, 2018, Carter-Pritchett Advertising, Inc., filed a request for a variance from subsection 14-10.004(7)(d), F.A.C., which directs that no sign permit shall be issued for a sign to be located outside the boundaries of an incorporated municipality and within 500 feet of an interchange, intersection at grade, or rest area on the interstate. The Department granted the variance because Carter-Pritchett has satisfied the requirements for a variance under Section 120.542, Florida Statutes.

The Department of Children and Families (DCF) is hosting community discussions throughout the state regarding Infant and Early Childhood Mental Health. Infant mental health refers to how well a child develops socially and emotionally. Understanding infant mental health is the key to preventing and treating the mental health problems of very young children and their families. Infant and early childhood mental health reflects both the social-emotional capacities and the primary relationships in children. The first years of life provide the foundation for children’s mental health and their social-emotional development.
The Department of Children and Families will host seven meetings throughout the State to discuss infant and early childhood mental health. The Department would like to invite infant and early mental health providers to join the discussion on infant and early childhood mental health services, and best practices.
Through the collaboration of all involved, attendees will come together to identify community resources to provide guidance, best practices, interventions, and connections to promote infant and early childhood mental health services.
The purpose of these meetings is to gather early childhood partners to discuss what is happening around the state, facilitate connections, and discuss next steps towards supporting services for early childhood mental health.
Providers and those involved with the 0-5 population are invited to attend. Seven meetings have been scheduled.

C2 Financial Corporation; On 6/7/2018, the Florida Office of Financial Regulation (Consumer Finance) received a Petition for Declaratory Statement from C2 Financial Corporation. The petition sought a declaratory statement from the Office on whether Chapter 494, Florida Statutes would permit Petitioner to pay a referral fee to its California employee who performs no services referenced in Sec 494.001(17) without the need for the California employee to be licensed/registered in Florida. *******On August 2, 2018, the Florida Office of Financial Regulation issued a Final Order on the Petition for Declaratory Statement. The Office determined that under the circumstances described, the transactions described by Petitioner amounts to directly soliciting or indirectly offering to solicit mortgage loans as contemplated within the loan originator definition under chapter 494, Florida Statutes. Therefore, the proposed activities would require “Loan Originator A” to be licensed as a mortgage loan originator pursuant to chapter 494, Florida Statutes.

George Mosle and Alison Williams; The original Notice of Petition for Declaratory Statement was published in Vol. 44, No. 97, of the May 17, 2018, Florida Administrative Register. The Petitioner sought the Commission’s interpretation of Rule 61J2-3.012, F.A.C., regarding equivalency standards for the pre-licensing education requirements set forth in Section 475.17(2)(a), Florida Statutes, which applies to Florida real estate sales associate and broker applicants and Section 475.181(2), Florida Statutes, which requires an applicant to pass the licensing examination within two years of completing the pre-licensing education requirement. The Commission considered the Petition at a duly-noticed public meeting held on June 20, 2018, in Orlando, Florida. At its meeting, the Commission denied the Petition finding that Petitioner did not meet the criteria and procedure pursuant to Section 475.17(2)(a)1., F.S. and Rule 61J2-3.008(1), F.A.C. The Order was filed on August 1, 2018.

The Petitioner sought the Commission’s interpretation of Section 475.25(1)(h), Florida Statutes, regarding the legality of paying additional rent based on a percentage of Petitioner’s gross sales and rent volume obtained from the sale and lease of properties within the community. The Commission considered the Petition at a duly-noticed public meeting held on April 18, 2018 and on June 20, 2018, in Orlando, Florida. At its meeting on June 20, 2018, the Commission granted the Petition finding that the specific lease provisions do not violate Section 475, F.S. The Order was filed on August 1, 2018.
