On September 4, 2020, the Florida Housing Finance Corporation issued an order granting a waiver of Rules 67-21.003(1)(b), 67-21.026(13)(f) and 67-21.026(13)(h) Fla. Admin. Code for Platform 3750, LLP, allowing Petitioner's General Contractor to contract with an affiliated company, CB Structures, Inc. to perform the shell work, to exceed the 31% limitation of the construction cost for a subcontract for the shell work, and to allow Petitioner to apply for the non-competitive housing credits early under the following conditions: A. All costs for the affiliated work attributable to the affordable units will be at cost with no profit or other fees built in; B. The General Contractor Fee on the affiliated costs attributable to affordable units will be capped at 10%; C. An independent CPA will confirm/audit all payments between the Affiliate entities and will verify 100% of the work performed by the Affiliate entity; and D. As part of the cost certification process, in addition to confirming/auditing all payments between the Affiliate entities, an independent CPA will confirm/verify an additional 40% of the Development's costs per the Final Cost Certification Application Package. Florida Housing determined that the Petitioner had demonstrated that it would suffer a substantial hardship if the waiver was not granted. The petition was filed on August 19, 2020 and notice of the receipt of petition was published on August 20, 2020 in Vol. 46, Number 163 F.A.R.

On August 20, 2020 the Division of Hotels and Restaurants received a Petition for a Routine Variance for Subparagraph 3-305.11(A)(2), 2017 FDA Food Code, Section 3-305.14, 2017 FDA Food Code, Section 6-202.15, 2017 FDA Food Code, Section 6-202.16, 2017 FDA Food Code, Paragraph 61C-4.010(1), Florida Administrative Code, and Paragraph 61C-4.010(6), Florida Administrative Code from LILYS CATERING SERVICE INC located in Orlando. The above referenced F.A.C. addresses the requirement for proper handling and dispensing of food. They are requesting to dispense bulk time/temperature control for safety foods from an open air mobile food dispensing vehicle.
The Petition for this variance was published in Vol 46/164. The Order for this Petition was signed and approved on September 9, 2020. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring that each pan within the steam table is properly covered with an individual lid; the steam table is enclosed within a cabinet with tight-fitting doors, and is protected by an air curtain installed and operated according to the manufacturer’s specifications that protects against flying vermin or other environmental contaminants; all steam table foods must be properly reheated for hot holding at approved commissaries and held hot at the proper minimum temperature per the parameters of the currently adopted FDA Food Code; and steam table food is to be dispensed by the operator with no customer self-service. The Petitioner shall also strictly adhere to the operating procedures and copies of the variance and operating procedures are to be present on the MFDV during all periods of operation.

A Routine Variance for Paragraph 61C-4.010(7) Florida Administrative Code and Paragraph 61C-4.010(6), Florida Administrative Code and Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Section 5-203.13, 2009 FDA Food Code from MOMENTO CAFÉ LLC located In Miami. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers and employees and the requirement that at least one service sink is provided for the cleaning of mops or similar cleaning tools and the disposal of mop water. They are requesting to share the bathrooms and mop sink located within a nearby establishment under a different ownership for use by customers and employees.
The Division of Hotels and Restaurants will accept comments concerning the Petition for 14 days from the date of publication of this notice. To be considered, comments must be received before 5:00 p.m.

On August 21, 2020, the Department of Agriculture and Consumer Services issued a final order in Case No. B25258 granting a petition for variance from Florida Administrative Code Rule 5K-4.034(4)(a) filed by Nathan Gerhardt, Esq. on behalf of Charlotte’s Web, Inc. No comments were received in response to the petition. The order grants a variance from the requirement to provide the most recent food safety inspection report to be considered an Approved Source. The Department of Agriculture and Consumer Services determined that the Petitioner demonstrated the purpose of the underlying statute had been met and that it would suffer a substantial hardship if the variance was not granted. The petition was filed on June 19, 2020, and the notice of receipt of the petition was published on June 25, 2020, in Volume 46, Number 124 of the Florida Administrative Register.

Variance from Florida Administrative Code subparagraph 64E-16.007(2)(a)2., from WNWN International, Inc., Petitioner, on behalf of Miquel Lozano, representing, Tesalys. This rule prescribes the specific placement of biological indicators in each treatment cart prior to treatment. The Petitioner requests a variance from the rule to allow the Petitioner to place the biological indicators in the center of the untreated biomedical waste load. Comments on this petition should be filed with Agency Clerk, Department of Health, Office of General Counsel, 4052 Bald Cypress Way, BIN A02, Tallahassee, Florida 32399-1703, within 14 days of publication of this notice.

The Florida Department of Transportation (FDOT) will hold a virtual public meeting (VPM) regarding proposed resurfacing improvements on Central Avenue (S.R. 19) from Golden Gem Drive to south of Palmetto Street. Proposed improvements include resurfacing all travel lanes, shoulders, and on-street parking areas. Also involved in the project are narrowing the median between the travel lanes to accommodate a bicycle lane, reconstruct the sidewalk, and improve related drainage, signage, and pavement markings.
This VPM will be held on Thursday, September 17, 2020, beginning at 5:30 p.m. The meeting is being conducted as a VPM, which is a free live presentation or webinar over the internet. The State Child Abuse Death Review (CADR) Committee has planned a collaborative webinar meeting. The meeting will focus on ways to reduce preventable child abuse deaths in Florida. The Committee makes policy and program recommendations to improve child health, safety and protection. The Participants will address any administrative issues and work cooperatively to develop plans for initiating local and statewide action in direct response to preventable child deaths reviewed by local CADR committees.
