The proposed rule is being developed to update testing offered at the Bronson Animal Disease Diagnostic Laboratory and the fee schedule associated with the testing. Industry partners including Pilgrim’s Pride, Florida Cattlemen’s Association, Cal-Maine, and the Animal Industry Technical Council (AITC) were consulted and they are in agreement with the proposed changes. THE lab offers this testing as a service and not as a required regulatory fee.

The Board proposes the development of a rule amendment to reduce the payment of a delinquent fee from $40.00 to $25.00.

The purpose and effect of this rulemaking is to repeal Rule 5E-2.040, Florida Administrative Code, made obsolete by revisions to Section 487.041, Florida Statutes related to supplemental registration fees for certain pesticides that contain active ingredients for which the United States Environmental Protection Agency has established food tolerance limits which were effective July 1, 2017.

This Notice provides a substantial rewording of rule 60A-1.006, F.A.C., which removes unnecessary wording and provides clarification of the criteria by which the Department evaluates possible vendor suspension and reinstatement, and repeals rule 60A-1.011, F.A.C., which is unnecessary to accomplish the objectives of the laws implemented.

On May 30, 2017, the petition for a variance filed on March 20, 2017, by Denise Kalman-Smith, representing South Lake Elks Lodge #1848, Inc., regarding the "South Lake Elks Lodge #1848, Inc." was WITHDRAWN. Petitioner had sought a variance from Rule 64E-11.007(5), Florida Administrative Code, which requires each food service establishment to be provided with adequate, readily accessible, conveniently located lavatories equipped with hot and cold running water in accordance with the plumbing authority. Notice of the petition was published in the March 27, 2017, edition of the Florida Administrative Register.

This hearing offers people the opportunity to express their views about the location, conceptual design, and social, economic, and environmental effects of constructing the bridge. The study limits are Recker Highway from east of Barton Park Road to US 92 and Thornhill Road from Recker Highway to one-half mile south of Recker Highway. The proposed improvements include widening Recker Highway from two to four lanes, including the addition of bike lanes and sidewalks, the construction of a new bridge to carry Recker Highway over the CSX railroad, and construction of access roads. The project will also change the Access Classification from Class 6, a non-restrictive roadway, to Class 5, a restrictive roadway. Chapter 335.199, Florida Statutes, requires a public hearing to present the proposed Access Classification change when any project on the State Highway System closes or modifies an existing access. A video will explain the project. Interested people can make oral comments, or complete a comment sheet either at the hearing or at a later date and mail it to FDOT by September 29, 2017.

The Agency is hosting a working group meeting regarding transition to a prospective payment system for nursing home reimbursement under the Florida Medicaid program.
The 2017 Legislature required the Agency to convene a working group to review relevant issues and make recommendations specific to the transition to a prospective payment system for nursing home reimbursement under the Florida Medicaid program. The group shall consist of representatives of nursing home providers and other interested stakeholders. The working group’s focus shall include, but not be limited to: any adjustments needed to existing targets and ceilings applicable to rate calculations; any adjustments needed to existing direct care and indirect care subcomponents; development and refinement of quality measures to be used; the frequency of rebasing under prospective payments; any exemptions from prospective payments; considerations for supplemental payments as part of prospective payments; and a phase-in timeline, if needed, including the need for any transition payments during phase-in. The working group shall submit a report and any recommendations to the Agency, the Governor, the President of the Senate, and the Speaker of the House of Representatives by December 1, 2017.

(2014), require the use of the types of construction provisions provided in the Florida Building Code (FBC), 5th Ed. (2014); 2) Whether the types of construction requirements of the FBC apply and prevail over the types of construction provisions provided in the occupancy chapters of the FFPC, 5th Ed. (2014); and 3) Whether [the State Fire Marshal’s] refusal to recognize the Florida specific amendments directing the use of the types of construction provided in the FBC over the types of construction or construction classifications provided in the occupancy chapters of the FFPC, National Fire Protection Association (NFPA) 101, constitute the adoption of a building code. The Department concludes the following: 1) Yes, the Florida specific amendments provided in sections 1.1.7, 8.2.1, and 8.2.1.2 of the FFPC, 5th Ed. (2014), require the use of the types of construction provisions provided in the FBC, 5th Ed. (2014). Sections 1.1.7, 8.2.1, and 8.2.1.2 FFPC, 5th Ed. (2014), are Florida specific amendments and outline the use of the FBC as it relates to the NFPA 220 and construction classifications. Sections 1.1.7, 8.2.1, and 8.2.1.2 FFPC, 5th Ed. (2014), provide for the use of the most current FBC; 2) Yes, the types of construction requirements of the FBC apply and prevail over the types of construction provisions provided in the occupancy chapters of the FFPC, 5th Ed. (2014). Section 1.1.7 FFPC, 5th Ed. (2014), states “the [FBC] shall be referred to anytime a reference is made to the building code or to NFPA 220, Standard on Type of Building Construction, in this Code or an adopted standard;” and 3) No, the State Fire Marshal’s refusal to recognize the Florida specific amendments directing the use of the types of construction provided in the FBC over the types of construction or construction classifications provided in the occupancy chapters FFPC, NFPA 101, does not constitute the adoption of a building code. Pursuant to sections 120.565 and 633.104(6), Florida Statutes, and chapter 28-105 and Rule 69A-60.007, Florida Administrative Code, the Department has authority to interpret the FFPC and to issue a declaratory statement with respect thereto. Declaratory statements issued by the Department do not constitute the making or adopting of a building code.
