On August 29, 2016 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Paragraph 61C-4.010(7) Florida Administrative Code and Paragraph 61C-4.010(6), Florida Administrative Code from Downtown Catering LLC located in Melbourne. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers. They are requesting to share the bathrooms located within a nearby establishment under a different ownership for use by customers only.
The Petition for this variance was published in Vol. 42/175 on September 8, 2016. The Order for this Petition was signed and approved on September 14, 2016. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the bathrooms located within Chris Haircut Shop (1912 Post Rd Suite A Melbourne, FL 32935), are maintained in a clean and sanitary manner and are provided with cold running water under pressure, soap, approved hand drying devices, and are available during all hours of operation. The Petitioner shall also ensure that directional signage is installed within or outside the establishment clearly stating the location of the bathrooms. If the ownership of Downtown Catering LLC and/or Chris Haircut Shop (Chris's Haircut Shop, LLC) changes, an updated signed agreement for use of the bathroom facilities will be required immediately.

FDOT is preparing design plans to widen State Road (SR) 82 from Lee Boulevard to Shawnee Road and from Shawnee Road to Alabama Road in Lee County. The Financial Project ID (FPID) numbers are: 425841-1-32-01 and 425841-2-32-01.
The proposed improvements include widening both segments of SR 82 from an existing two-lane roadway to a six-lane divided roadway. The corridor will have a median separating three 12-foot travel lanes in each direction, 6.5-foot inside and outside paved shoulders, a five-foot sidewalk on the north side and a 10-foot shared-use path on the south side. With the addition of a median through this segment, FDOT is developing a plan for median openings and turn lanes.
The purpose of the scheduled meeting is to present information and to obtain comments about the proposed widening plans for both segments of SR 82. An informal video will run continuously throughout the open house. This video will illustrate how the Continuous Flow Intersection at Daniels Parkway/Gunnery Road will operate. You can attend anytime during the open house to review project information and talk one-on-one with the design team.

The Agency is hosting a public meeting regarding Nursing Home Prospective Payment Reimbursement Methodology for use in determining payment for nursing home services.
During the 2016 Legislative Session, Legislation passed requiring the Agency to contract with an independent consultant to develop a plan to convert Medicaid payments for nursing home services from a cost based reimbursement methodology to a prospective payment system. The Agency has entered into a contract with Navigant Healthcare to support the completion of this initiative. Navigant will work with the Agency to develop a nursing home prospective payment system resulting in a final design document for submission to the Governor, President of the Senate, and the Speaker of the House of Representatives no later than January 1, 2017.
