- On December 07, 2015 the Division of Hotels and Restaurants received a Petition for a Routine Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code, Section 5-203.13, 2009 FDA Food Code, Paragraph 4-301.12(A), 2009 FDA Food Code, Paragraph 61C-4.010(5), Florida Administrative Code, Subparagraph 3-305.11(A)(2), 2009 FDA Food Code, and Paragraph 61C-4.010(1), Florida Administrative Code from Arctic Expeditions @ WDW located in Lake Buena Vista. The above referenced F.A.C. addresses the requirement that at least one service sink is provided for the cleaning of mops or similar cleaning tools and the disposal of mop water; that dishwashing facilities for manually washing, rinsing and sanitizing equipment and utensils are provided, and that each establishment have areas for food preparation and storage. They are requesting to share the mop sink, dishwashing, food preparation and food storage areas with another licensed food service establishment under the same ownership and on the same premise.
The Petition for this variance was published in Vol. 41/240 on December 14, 2015. The Order for this Petition was signed and approved on December 29, 2015. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring that the mop sink, dishwashing sink and food preparation and storage areas within Lottawatta Lodge (SEA5807667) and Avalunch Blizzard Beach (SEA5807675)are maintained in a clean and sanitary manner, all sinks are provided with hot and cold running water under pressure and are available during all hours of operation. The handwash sinks must also be provided with soap, an approved hand drying device and a handwashing sign. If the ownership of Lottawatta Lodge (Walt Disney World Co) changes, a signed agreement between the two establishments for the use of the shared facilities must be provided to the division immediately.

The above referenced F.A.C. addresses the requirement for proper handling and dispensing of food. They are requesting to dispense bulk time/temperature control for safety foods from an open air mobile food dispensing vehicle.
The Petition for this variance was published in Vol. 41/241 on December 15, 2015. The Order for this Petition was signed and approved on December 31, 2015. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring that each pan within the steam table is properly covered with an individual lid; the steam table is enclosed within a cabinet with tight-fitting doors, and is protected by an air curtain installed and operated according to the manufacturer’s specifications that protects against flying vermin or other environmental contaminants; all steam table foods must be properly reheated for hot holding at approved commissaries and held hot at the proper minimum temperature per the parameters of the currently adopted FDA Food Code; and steam table food is to be dispensed by the operator with no customer self-service. The Petitioner shall also strictly adhere to the operating procedures and copies of the variance and operating procedures are to be present on the MFDV during all periods of operation.
- On December 15, 2015 the Division of Hotels and Restaurants received a Petition for a Routine Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from Rhokkohs Frozen Yogurt located in Daytona Beach. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink in the new food preparation area.
The Petition for this variance was published in Vol. 41/243 on December 17, 2015. The Order for this Petition was signed and approved on January 4, 2016. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the handwash sink is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash sink is provided with hot and cold running water under pressure, soap, an approved hand drying device and a handwashing sign.

The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers and employees. They are requesting to utilize the bathroom facilities located within an adjacent business under the same ownership for use by both customers and employees.
The Petition for this variance was published in Vol. 41/248 on December 28, 2015. The Order for this Petition was signed and approved on January 4, 2016. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring that the bathroom facilities within Sam's Food Store are maintained in a clean and sanitary manner, a hand sink is provided with hot and cold running water under pressure and are available during all hours of operation. The Petitioner shall also ensure that all handwash sinks used by employees are provided with a handwash sign, soap and approved hand drying devices. The Petitioner shall also ensure directional signage is installed within or outside the establishment clearly stating the location of the bathrooms. If the ownership of Sam's Food Store and Georgia Boy BBQ & Bistro changes (Sammie Solomon), a signed agreement for use of the facilities is required immediately.

- On November 18, 2015, the Agency issued a Final Order Temporarily Granting Petition for Emergency Variance from or Waiver of Fla. Admin. Code R. 59G-13.070. The Agency’s order was filed in response to a Petition for Emergency Variance or Waiver of Rule 59G-13.070 (“Petition”), filed on behalf of the Petitioner, A.G., on October 19, 2015. Notice of the Petition was published in Volume 41, No. 207, of the October 23, 2015, Florida Administrative Register. Rule 59G-13.070 of the Florida Administrative Code (“Rule”), which applies to all providers of Developmental Disabilities Individual Budgeting Waiver services who are enrolled in the Florida Medicaid program, requires that all providers of Developmental Disabilities Individual Budgeting Waiver services enrolled in the Florida Medicaid program be in compliance with the provisions of the Florida Medicaid Developmental Disabilities Individual Budgeting Waiver Services Coverage and Limitations Handbook, September 2015 (“Handbook”). Petitioner sought a variance from or waiver of the Handbook provision, page 2-97, Limitations and Exclusions, which limits behavior assistant services to a maximum of 32 quarter-hours per day. Based on the information presented in the Petition, the Agency found that Petitioner had temporarily established that a strict application of Rule 59G-13.070 of the Florida Administrative Code and the subject Handbook provisions would lead to unreasonable, unfair, and unintended results.

This public hearing is being held to allow interested persons an opportunity to provide comments concerning the location, conceptual design, and social, economic, and environmental effects of widening US 41 from Kracker Avenue to south of SR 676 (Causeway Boulevard), a distance of approximately 7 miles. The widening of US 41 is proposed as a six-lane divided roadway with pedestrian and bicycle facilities.
Department representatives will be available at the public hearing beginning at 5:30 pm to answer questions and discuss the project informally. Draft project documents and other project related materials will be displayed, and a PowerPoint presentation will run continuously during the open house. At 6:30 pm, FDOT representatives will begin the formal portion of the hearing, which will provide an opportunity for attendees to make formal oral public comments. Following the formal portion of the hearing, the informal open house will resume and continue until 7:30 pm. A court reporter will be available to receive comments in a one-on-one setting. - Proposed Amendment to Florida’s 1115 Managed Medical Assistance (MMA) Waiver
SUMMARY DESCRIPTION OF PROPOSED AMENDMENT: The State is seeking federal authority to amend Florida’s 1115 MMA Waiver (Project Number 11-W-00206/4) to amend the language related to the Hemophilia Program to allow for up to three vendors in order to provide the State the flexibility to contract with 1-3 vendors, amend the waiver to include payment in MMA capitation rates for nursing facility services for recipients under the age of 18 years, and amend the waiver to allow flexibility for Specialty Plans that do not have sufficient numbers of eligible members for the mandatory Performance Improvement Projects (PIPs) to conduct PIPs on other topics that have more impact on their members, with Agency approval.

PUBLIC NOTICE AND PUBLIC COMMENT PERIOD: The Agency will conduct a 30-day public notice and comment period prior to the submission of the proposed amendment request to Federal Centers for Medicare and Medicaid Services (CMS). The Agency will consider all public comments received regarding the proposed amendment request. The 30-day public notice and public comment period is from January 12, 2016 through February 11, 2016. This public notice and public comment period is being held to solicit public input from recipients, providers and all stakeholders and interested parties on the development of the proposed amendment request to Florida’s 1115 MMA Waiver.
