- On December 11, 2017 the Division of Hotels and Restaurants received a Petition for a Routine Variance for Paragraph 61C-4.010(7) Florida Administrative Code and Paragraph 61C-4.010(6), Florida Administrative Code from Lucy's Snow and Coffee located in Fort Myers. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers. They are requesting to share the bathrooms located within a nearby establishment under a different ownership for use by customers only.
The Petition for this variance was published in Vol. 43/238 on December 12, 2017. The Order for this Petition was signed and approved on December 28, 2017. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the bathrooms located within Leonis Pizzeria (Ba Pizza Inc.), are maintained in a clean and sanitary manner and are provided with cold running water under pressure, soap, approved hand drying devices, and are available during all hours of operation. The Petitioner shall also ensure that directional signage is installed within or outside the establishment clearly stating the location of the bathrooms. If the ownership of Lucy's Snow and Coffee (Walter Munoz) and/or Leonis Pizzeria ( Ba Pizza Inc.) changes, an updated signed agreement for use of the bathroom facilities will be required immediately.
- On December 15, 2017 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 3-305.11(A)(2), 2009 FDA Food Code, Section 3-305.14, 2009 FDA Food Code, Section 6-202.15, 2009 FDA Food Code, Section 6-202.16, 2009 FDA Food Code, Paragraph 61C-4.010(1), Florida Administrative Code, and Paragraph 61C-4.010(6), Florida Administrative Code from Antojitos Prosperos located in Orlando. The above referenced F.A.C. addresses the requirement for proper handling and dispensing of food. They are requesting to dispense bulk time/temperature control for safety foods from an open air mobile food dispensing vehicle.
The Petition for this variance was published in Vol. 43/242 on December 18, 2017. The Order for this Petition was signed and approved on December 28, 2017. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring that each pan within the steam table is properly covered with an individual lid; the steam table is enclosed within a cabinet with tight-fitting doors, and is protected by an air curtain installed and operated according to the manufacturer’s specifications that protects against flying vermin or other environmental contaminants; all steam table foods must be properly reheated for hot holding at approved commissaries and held hot at the proper minimum temperature per the parameters of the currently adopted FDA Food Code; and steam table food is to be dispensed by the operator with no customer self-service. The Petitioner shall also strictly adhere to the operating procedures and copies of the variance and operating procedures are to be present on the MFDV during all periods of operation.
- On December 13, 2017 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Section 5-203.13, 2009 FDA Food Code from Taco Republik Tallahassee Midtown LLC located in Tallahassee. The above referenced F.A.C. addresses the requirement that at least one service sink is provided for the cleaning of mops or similar cleaning tools and the disposal of mop water. They are requesting to share the mop sink located within an adjacent business.
The Petition for this variance was published in Vol. 43/246 on December 22, 2017. The Order for this Petition was signed and approved on December 28, 2017. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the mop sink located on the premises of Red Eye Coffee Shop, 1122-7 Thomasville Rd. Tallahassee, FL 32303, is maintained in a clean and sanitary manner and is provided with hot and cold running water under pressure. If the ownership of Taco Republik (Taco Republik Tallahassee Midtown LLC SEA4703321) and/or Red Eye Coffee Shop (Jason Mc Arthur) changes, a signed agreement for use of the mop sink is required immediately.

- On December 1, 2017, the Department of Health issued an order in response to a petition for a variance filed on February 6, 2017, by Marshall T. Mott-Smith, representing Modern Welding Company of Florida, Inc., regarding the "coated steel passive grease interceptor". Petitioner sought a variance from Rules 64E-6.013(1)(a), (1)(d), (1)(f), (2)(a), (2)(h), (4) and (7)(d), Florida Administrative Code, which provide the standards for the design, construction and testing of treatment receptacles for onsite sewage treatment and disposal systems, including construction materials, tests observed by a Florida-Licensed Engineer, traffic lid standards, tank compartment sizing, inter-compartment connectivity, annual manufacturing inspection, and overall capacity. Notice of the petition was published in the February 10, 2017, edition of the Florida Administrative Register.
The Department found that the Petitioner demonstrated that the underlying intent of the statute could be achieved by alternative means and that strict application of the rules would violate principles of fairness and would create a substantial hardship in the Petitioner's particular circumstance. Therefore, pursuant to the requirements of section 120.542(2), Florida Statutes, the Department GRANTED WITH CONDITIONS Petitioner's request for a variance.

The Petition for Variance or Waiver was filed by Judy Caldwell, on October 4, 2017, seeking a variance or waiver of Rules 61J2-3.011 and 61J2-17.016, F.A.C., of the 7 hours of recertification education for instructor license.
The Commission considered the Petition at a duly-noticed public meeting held on November 15, 2017 in Orlando, Florida. At its meeting, the Commission granted the Petition. Petitioner has until September 30, 2018 to complete education requirements for her renewal of her instructor’s license.
