- that Utility Inc. of Florida’s petition for waiver from Rule 25-30.030(5)(b), Florida Administrative Code, filed August 9, 2017, in Docket No. 20170174-SU was partially approved by the Commission by Order No. PSC-2017-0387-PAA-SU, issued October 11, 2017, consummated by Order No. PSC-2017-0422-CO-SU, issued November 6, 2017. The rule addresses the customer noticing provisions for an application to amend a utility’s service territory. The petition was partially approved on the basis that the purpose of the underlying statute would be achieved by other means and strict application of the rule would create substantial hardship. Notice of the petition was published in the FAR on August 21, 2017. - that on January 5, 2018, the Department entered an Order Granting Variance from Rule 14-57.013, Florida Administrative Code (F.A.C.). On December 12, 2017, the Department received a petition for a temporary variance from Vulcan Materials Company from Rule 14-57.013, F.A.C., to delay the installation of roadside flashing lights and gates at a new rail crossing located at Stone Boulevard in Cantonment, Florida. The Department granted the variance because Vulcan demonstrated that a strict application of Rule 14-57.013, F.A.C., would create a substantial hardship on Vulcan and violate principles of fairness.

- This Alternatives Public Meeting is being conducted to give interested persons an opportunity to review the proposed alternatives under consideration and to express their views concerning the location, conceptual design, and social, economic, and environmental effects of the proposed pedestrian improvements to US 41 (SR 45) from 69th Avenue (Bay Drive) to 63rd Avenue W. and from 53rd Avenue W. to Cortez Road in Manatee County, Florida. Financial Project ID No. 433592-1-52-01. US 41 (SR 45) is a north-south oriented, seven-lane, undivided roadway. Surrounding land use is predominantly commercial development. Major deficiencies within the study area generally include disjointed sidewalks and insufficient or nonexistent lighting and signage. The need for the project is to provide a continuous pedestrian corridor along US 41 (SR 45) and evaluate potential lighting as well as signal improvements. The purpose of this project is to facilitate the use of viable, non-motorized travel options for commuters and recreational users along the US 41 (SR 45) pedestrian corridor and within the Bradenton community. Petitioner asks whether administering the Bravo pH monitoring system when a physician is not in the building is within the scope of practice of a registered nurse as defined in 464.003(20) F.S. The Board’s Order, filed on January 2, 2018, states that the petition is in substantial compliance with the provisions of Section 120.565, F.S. and Rule 28-105, F.A.C., and that under the specific facts of the petition, it is not within the scope of Petitioner’s nursing practice to administer Bravo pH monitoring capsule without a physician present.
