- The purpose of this amendment is to change subsections 18-1.002(2), (4), (6), (7), and (27), to remove references to the Uniform Standards of Professional Appraisal Practice "USPAP"; add the Appraisal Institute as an "Approved appraisal organization"; and include the effective dates for Supplemental Appraisal Standards for the Board of Trustees. Additionally, subsection 18-1.006(1) will be revised to remove reference to USPAP. Finally, subsection 18-1.007 F.A.C. (1)(b)4., 5., (5), (5)(a), and (6) will remove reference to USPAP and add reference to the Supplemental Standards for the Board of Trustees, as USPAP is a standard included within the Supplemental Standards Board of Trustees Appraisers are required to follow.

- On September 27, 2012, the Department received a letter withdrawing the Petition for variance from Heartland of St. Pete, filed July 20, 2012 and advertised on August 3, 2012 in Vol. 38, No 31, of the Florida Administrative Register (formerly FAW). The Petition for variance requested a variance from an unspecified section of, ASME A17.3, 1996 edition, as adopted by Chapter 30, Section 3001.2 Florida Building Code adopted by 61C-5.001(1)(a), Florida Administrative Code that requires upgrading the elevators. The Department of Business and Professional Regulation, Division of Hotels and Restaurants, Bureau of Elevator Safety is taking no further action on the petition (VW2012-239)
- Madison Street Mixed-Use Redevelopment Project. Petitioner seeks a variance of the requirements of ASME A17.1b, Section 2.20.4, 2.24.2.1 as adopted by 61C-5.001(1)(a), Florida Administrative Code that requires steel ropes of a minimum diameter of 9.5 mm and requirement of a metallic sheave which poses a significant economic/financial hardship. - On September 14, 2012, granted a Final Order. This Order (12-0008) granted variance/waiver under Section 120.542, F.S., to Columbia County Board of Commissioners, P. O. Box 1529, Lake City, FL 32056. The petition for variance was received by SRWMD on July 17, 2012, and revised on August 15, 2012. Notice of receipt of petition requesting variance was published in F.A.W., Vol. 38, Number 31, on August 3, 2012. No public comment was received. This Order provides variance/waivers from SRWMD from subsection 40B-4.3030(12), F.A.C., as to the 75-foot setback requirements. Petitioner states that the existing Bridge site is in need of repair due to eroding banks from misuse and this would improve water quality and reduce sedimentation. The project is located in Columbia County, Township 1 North, Range 16 East, Section 36. SRWMD granted the petition because the petitioner has demonstrated that the purpose of the statute underlying the rule will be met and that a substantial hardship would be created if the petitioners were required to comply with this rule.

Action will be taken under Chapter 62-552, F.A.C., to add new construction projects that submitted planning documents, plans, specifications, and permits by September 17, 2012, and pre-construction projects that submitted a complete Request for Inclusion by that date, to the contingency or fundable portion of the priority list based on availability of funds. Projects shall be subject to a segment cap limit.
The Department may adopt, modify, or deny the proposed actions at the hearing. Prior to Department action at the hearing, all interested persons will have the opportunity to testify regarding any proposed actions. After the hearing, the Department will file the Notice of Final Agency Action. A copy of the Notice of Final Agency Action will be sent to local governments sponsoring the projects at issue and to any person submitting a timely written request. Such written requests must be submitted at the hearing or filed with the Department’s Bureau of Water Facilities Funding no later than 5:00 p.m. on the first working day after the public hearing.
