The proposed rules also amend the water conservation measures in the Basis of Review for Water Use Permit Applications within the South Florida Water Management District to be consistent with the landscape irrigation conservation measures set forth in Chapter 40E-24, F.A.C.

- The purpose of this rule amendment is to incorporate by reference the Florida Medicaid Provider Reimbursement Handbook, ADA Dental Claim Form, July 2008. The handbook replaces the Florida Medicaid Provider Reimbursement Handbook, Dental 111. Dental providers are required to bill on the ADA Dental Claim Form when submitting paper claims. The handbook also contains updated references for the new Medicaid fiscal agent. The effect will be to incorporate by reference in rule the Florida Medicaid Provider Reimbursement Handbook, ADA Dental Claim Form, July 2008.
In the Notice of Rule Development, published in Volume 33, Number 48, Florida Administrative Weekly, dated November 30, 2008, we stated that the handbook effective date was March 2008. We changed this date to July 2008.

- Order WV-08-01 grants a temporary variance, with conditions, from a portion of rule 68C-22.025, Florida Administrative Code, (the manatee protection rule for Miami-Dade County) to SPAD Films, Inc (“SPAD”). The petition was filed with the Commission on September 17, 2008, and a notice of petition was published in the Florida Administrative Weekly on October 3, 2008. The Commission did not receive any comments on the petition. The variance authorizes SPAD to operate up to three motorboats above regulated speeds, with speeds not to exceed 20 knots (23 mph), while filming a scene for the “RTT” motion picture. The variance applies for no more than one day of filming on October 20-30, 2008. A variance was granted because the Commission determined that the statutory requirements for the granting of a variance were met, specifically through the implementation of a Commission-approved manatee watch program and by the setting of other conditions and limitations on the activities.

- The Order is regarding the Petition for Waiver or Variance, filed on May 12, 2008, by Scott M. Sander. The Notice of Petition for Waiver or Variance was published in Vol. 34, No. 22, of the May 30, 2008, Florida Administrative Weekly. The Petitioner sought a waiver or variance of Rule 61H1-33.006(2), F.A.C., entitled “Inactive or Delinquent Florida Certified Public Accountants Who Desire to Become Active Licensees” which requires that the required continuing professional education (CPE) hours have been completed in the 24 months immediately proceeding the date of an application for reactivation. Petitioner also sought a waiver or variance of Rule 61H1-31.001(9), F.A.C., entitled “Fees,” which requires that the CPE reporting form be postmarked by or on July 15. If it is postmarked or completed on-line after July 15 but by December 31, a $50.00 delinquency fee will be imposed by the Board, and no CPE reporting form is accepted if it is postmarked or completed on-line after December 31. The Board considered the instant Petition at a duly-noticed public telephonic meeting, held July 15, 2008.
The Board’s Order granted the petition finding that Petitioner established that the purpose of the underlying statutes, Sections 473.311 and 473.312, F.S., would be met by granting a variance or waiver from Rules 61H1-31.001(9) and 61H1-33.006(2), F.A.C. The Board further found that Petitioner established that applying the requirements of the aforementioned Rule to his circumstances would violate principles of fairness and impose substantial hardship.

- On June 17th, 2008, the Department of Environmental Protection recieved a petitioned for variance from rule 62-4.244, Florida Administrative Code (F.A.C). The Department gives notice of its intent to grant a variance under Section 403.201, Florida Statutes (F.S.), from the provisions of Rule 62-4.244(5)(c), F.A.C., to Palm Beach County Department of Environmental Resources Management, to allow a temporary mixing zone of 200 meters offshore and 1,000 meters downcurrent (and 850 meters in the southern end in the vicinity of hardbottom) within an area of Class III Waters of the Atlantic Ocean. The variance is associated with the Juno Beach Nourishment project (File No. 0276415-001-JC). The activity is located at Juno Beach between FDEP reference monuments R-26 and R-38. A person whose substantial interests are affected by the Department's proposed action may petition for an administrative hearing in accordance with sections 120.569 and 120.57, Florida Statutes. The petition must contain the information set forth below and must be filed (received by the clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000.
Mediation under Section 120.573 of the Florida Statutes is not available.
Because the administrative hearing process is designed to redetermine final agency action on the application, the filing of a petition for an administrative hearing may result in a modification of the agency action or even a denial of the application. If a sufficient petition for an administrative hearing or request for an extension of time to file a petition is timely filed, this agency action automatically becomes only proposed agency action on the application, subject to the result of the administrative review process. Accordingly, the applicant is advised not to commence construction or other activities in accordance with this variance until the deadlines noted below for filing a petition for an administrative hearing, or request for an extension of time has expired.
Under rule 62-110.106(4), F.A.C., a person whose substantial interests are affected by the Department’s action may also request an extension of time to file a petition for an administrative hearing. The Department may, for good cause shown, grant the request for an extension of time. Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, before the applicable deadline. A timely request for extension of time shall toll the running of the time period for filing a petition until the request is acted upon.
In the event that a timely and sufficient petition for an administrative hearing is filed, other persons whose substantial interests will be affected by the outcome of the administrative process have the right to petition to intervene in the proceeding. Any intervention will be only at the discretion of the presiding judge upon the filing of a motion in compliance with rule 28-106.205, F.A.C.
In accordance with rules 28-106.111(2) and 62-110.106(3)(a)(1), F.A.C., petitions for an administrative hearing by the applicant must be filed within 14 days of receipt of this written notice. Petitions filed by any persons other than the applicant, and other than those entitled to written notice under section 120.60(3), F.S., must be filed within 14 days of publication of the notice or within 14 days of receipt of the written notice, whichever occurs first. Under section 120.60(3), F.S., however, any person who has asked the Department for notice of agency action may file a petition within 14 days of receipt of such notice, regardless of the date of publication.
The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing. The failure of any person to file a petition for an administrative hearing within the appropriate time period shall constitute a waiver of that person’s right to request an administrative determination (hearing) under sections 120.569 and 120.57, F.S.
In accordance with rule 28-106.301, F.A.C., a petition that disputes the material facts on which the Department’s action is based must contain the following information: (a) The name and address of each agency affected and each agency’s file or identification number, if known; (b) The name, address, and telephone number of the petitioner; the name, address, and telephone number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests are or will be affected by the agency determination; (c) A statement of when and how the petitioner received notice of the agency decision; (d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate; (e) A concise statement of the ultimate facts alleged, including the specific facts that the petitioner contends warrant reversal or modification of the agency’s proposed action; (f) A statement of the specific rules or statutes that the petitioner contends require reversal or modification of the agency’s proposed action, including an explanation of how the alleged facts relate to the specific rules or statutes; and (g) A statement of the relief sought by the petitioner, stating precisely the action that the petitioner wishes the agency to take with respect to the agency’s proposed action.
A petition that does not dispute the material facts on which the Department’s action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by rule 28-106.301, F.A.C. Under sections 120.569(2)(c) and (d), F.S., a petition for administrative hearing must be dismissed by the agency if the petition does not substantially comply with the above requirements or is untimely filed.
This action is final and effective on the date filed with the Clerk of the Department unless a petition is filed in accordance with the above. Upon the timely filing of a petition this order will not be effective until further order of the Department.
This variance constitutes an order of the Department. The applicant has the right to seek judicial review of the order under section 120.68, F.S., by the filing of a notice of appeal under rule 9.110 of the Florida Rules of Appellate Procedure with the Clerk of the Department in the Office of General Counsel, 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399 3000; and by filing a copy of the notice of appeal accompanied by the applicable filing fees with the appropriate district court of appeal. - The Department of Community Affairs (DCA) is seeking a public or nonprofit entity to administer the Weatherization Assistance Program (WAP) and the WAP-Low Income Home Energy Assistance Program (WAP-LIHEAP) in Monroe County. Entities interested in contracting with DCA to provide these services should be present at this public meeting in order to be informed of the qualifications and application requirements.
Selection of an entity will be based on the entities= experience and performance in weatherization or housing renovation activities, and in assisting low-income persons in the area to be served, and their capacity to undertake a timely and effective weatherization program. Preferences will be given to any Community Action Agency or other public or nonprofit entity which has, or is currently administering an effective DCA funded Weatherization Assistance Program.
The following qualities will be reviewed: (1) the extent to which the past or current program achieved or is achieving weatherization goals in a timely fashion; (2) the quality of work performed by the entity; (3) the number, qualifications, and experience of the staff members of the entity; (4) the ability of the entity to secure volunteers, train participants and public service employment workers; and (5) maintain compliance with administration and financial management requirements.
Only one entity will be funded and that entity must be capable and willing to provide services to all eligible low-income citizens in the geographic service area.

- This is the Final Public Hearing on the adoption of proposed rules 69V-40.002, 69V-40.031, 69V-.051, 69V-40.100, 69V-40.200, 69V-40.220, Florida Administrative Code, published on September 26, 2008, in Volume 34, Number 39, of the Florida Administrative Weekly. No changes have been made to the proposed rules.
The rules are being amended to increase fingerprint processing fees from $42.25 to $43.25. The current fee of $42.25 represents $23 charged by the Florida Department of Law Enforcement for a state criminal history check and $19.25 charged by the U.S. Department of Justice for a national criminal history check. During the 2008 regular session, the Florida Legislature passed Senate Bill 1792. This bill was signed into law (Chapter 2008-112, Laws of Florida) by Governor Crist on June 10, 2008. Effective July 1, 2008, the Florida Department of Law Enforcement will be increasing its fingerprint processing fee to $24 as required by Section 1 of Chapter 2008-112, Laws of Florida, which amends Section 943.053(3)(b), Florida Statutes. Also during the regular 2008 legislative session, the Florida Legislature passed House Bill 5049, which amended Section 494.0033, F.S., to reduce the mortgage broker license application fee from $200 to $195. This bill was signed into law (Chapter 2008-135, Laws of Florida) by Governor Crist. Form OFR-494-03, Application for Licensure as a Mortgage Broker, which is incorporated by reference in Rule 69V-40.002, F.A.C., is amended to reflect the reduction in the license application fee.
