- Subsection 69V-40.001(5), F.A.C., is amended to remove an unnecessary definition. The current rule provides that for purposes of Section 494.001(26), F.S., the term “receive” means obtaining possession of money or a negotiable instrument prior to receipt by the lender or investor. The term “received” is not used in Section 494.001(26), F.S. While the term “received” is used in Section 494.001(28), F.S., this definition is unnecessary and could be construed to the limit the statutory definition of the term “service a mortgage loan.” Rule 69V-40.008, F.A.C., is amended to eliminate subsection (8) pertaining to fees that can be charged or collected on a loan modification if the mortgage brokerage business previously brokered the loan. The current rule limiting fees based on whether a mortgage brokerage business previously brokered the mortgage loan is not supported by statutory authority. Rule 69V-40.022, F.A.C., is amended to correct a cross reference to the statute that requires the filing of quarterly reports. Rules 69V-40.051, .100, .200, and .220, F.A.C., are amended to eliminate an exemption from the requirement that all persons who are required to be disclosed on the license application form must file a fingerprint card and biographical form as part of the application process under Chapter 494, F.S. The current exemptions apply to persons who hold an active mortgage broker license. Rule 69V-40.290, F.A.C., is amended to correct a statutory cross-reference.

- The Split Pine Community Development District (“Split Pine CDD”), which is located in Duval County, Florida, and the Tolomato Community Development District (“Tolomato CDD”), which is located in St. Johns County, Florida, have submitted a joint petition requesting the merger of the two districts. As a result of the merger, Split Pine CDD would cease to exist, and Tolomato CDD would continue as the surviving entity, with amended boundaries that would encompass only the land presently in the existing boundaries of both Split Pine CDD and Tolomato CDD. At the time of establishment of both districts, Section 190.003 of the Florida Statutes prohibited the establishment of community development districts across county boundaries. Effective July 1, 2007, that prohibition no longer exists. Split Pine CDD and Tolomato CDD have written consent to merge the boundaries of the two districts from the owners of one hundred percent of the land within the existing districts.
The proposed rule would effect the merger in part by repealing the existing rules governing Split Pine CDD – specifically, Florida Administrative Code Rules 42TT-1.001, Establishment, 42TT-1.002, Boundary, and 42TT-1.003, Supervisors, F.A.C. Another proposed rule, which is separately noticed for simultaneous consideration, would further effect the merger by amending Rule 42SS-1.002, , F.A.C., Boundary to expand the boundaries of Tolomato CDD to include the existing Split Pine CDD lands.
- Seven Oaks Community Development District
- The petition, as supplemented, filed by the Seven Oaks Community Development District I (“Seven Oaks CDD I”) and the Seven Oaks Community Development District II (“Seven Oaks CDD II”) (together, “Petitioners”), requests the merger of the Seven Oaks CDD I and the Seven Oaks CDD II. On January 14, 2009, the Seven Oaks CDD I and the Seven Oaks CDD II adopted resolutions approving a an amended merger agreement. The amended merger agreement, among other things, makes provision for the filing of a petition, the proper allocation of the indebtedness, and the manner in which debt is to be retired. The amended merger agreements are contained as Second Supplemental Exhibit K-1 to the petition, as supplemented. The proposed merged District is located entirely within the unincorporated area of Pasco County, Florida and contains approximately 1,759 acres. Petitioners represent the resolutions approving the merger agreement, as amended, and the approved merger agreement for merger of the Districts by the Petitioners’ board of supervisors elected by the electors of the district constitutes consent to merge the boundaries of the Seven Oaks CDD I and the Seven Oaks CDD II. Both Seven Oaks CDD I and Seven Oaks CDD II are completely built out and there is no additional construction planned for either of the districts.

The Notice of Petition for Waiver or Variance was published in Vol. 35, No. 17, May 1, 2009, Florida Administrative Weekly. Petitioner sought a waiver or variance of paragraph 61H1-28.0052(1)(b), F.A.C., entitled “Number of Sittings, and Granting of Credit, Release of Grades and Completion of Examination, Transition Rules” which requires candidates to pass all four test sections of the CPA Examination within a rolling eighteen-month period, which begins on the NASBA grade release for the first test section passed. The Board considered the instant Petition at a duly-noticed public meeting on June 10, 2009, in Tampa, Florida.
The Board’s Order denied the petition finding that Petitioner failed to establish that the purpose of the underlying statute, Section 473.306, Florida Statutes, would be met by granting a variance or waiver from paragraph 61H1-28.0052(1)(b), F.A.C. The Board further found that Petitioner had failed to establish that applying the requirements of the aforementioned Rule to her circumstances would violate principles of fairness and impose substantial hardship.

- This is a Design Change Reevaluation public hearing. The hearing is being held to allow interested persons an opportunity to express their views concerning proposed design changes for the widening of US 17 in Hardee County.
The Florida Department of Transportation (FDOT), District One, conducted a Project Development and Environment (PD&E) Study that was approved by the Federal Highway Administration (FHWA) on July 11, 2006. The limits of the PD&E study extended from the DeSoto/Hardee County line to Third Avenue in Zolfo Springs.
In 2008, FDOT began conducting a design change reevaluation for Segment 1 of the original PD&E Study, from the DeSoto/Hardee County Line to just north of Charlie Creek. The design change reevaluation proposes using railroad right-of-way previously purchased by FDOT to implement a one-way pair system around the Brookside Bluffs Condominium Association and the Bluffs Golf Course. The one-way pair system will be constructed in two phases. The northbound lanes of US 17 were to be constructed within the railroad right-of-way and the southbound lanes of US 17 will be on the existing US 17 lanes.
A public hearing was held in conjunction with the design change reevaluation on December 15, 2008, in Hardee County. Based on comments received from the hearing and a request for additional information from the Federal Highway Administration, additional analysis has been conducted on the northbound lanes of the proposed US 17 one-way pair, to optimize the placement of a noise barrier and to minimize the impacts of the northbound lanes to the Brookside Bluffs Condominium Association and the Bluffs Golf Course. It is not necessary that the hearing be held or attended in order for persons to comment on DEP’s proposed SIP revision. Persons may submit comments by letter or e-mail to Ms. Scearce no later than January 28, 2010. The proposed SIP revision represents commitments and actions taken by the state affecting reasonable progress during the ten-year period from 2008 to 2018 towards the goal of attaining natural visibility conditions in designated Federal “Class I areas” by 2064. It also provides for the implementation of Best Available Retrofit Technology (BART). - Sonia Flores Machen; The petition asks eight complex questions, dealing with the interplay between Section 509.215, F.S., Chapter 663, F.S., and the rules comprising the Florida Fire Prevention Code, as they relate to fire sprinkler systems in transient public lodging facilities. The Declaratory Statement concludes that Chapter 509, Florida Statutes, provides a time frame for compliance with the sprinkler requirements contained therein. By January 1, 1994, all licensed transient public lodging facilities were required to be fully sprinklered; thereafter, they were required to meet the requirements of the Florida Fire Prevention Code for new and existing facilities.
