- On December 12, 2016 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Paragraph 61C-4.010(7) Florida Administrative Code and Paragraph 61C-4.010(6), Florida Administrative Code from Montoya Holdings Inc. located in Hialeah. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers. They are requesting to share the bathrooms located within a nearby establishment under a different ownership for use by customers only.
The Petition for this variance was published in Vol. 42/241 on December 14, 2016. The Order for this Petition was signed and approved on December 20, 2016. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the bathrooms located within Doctor Metales (221 West 26 St. Hialeah, FL 33010), are maintained in a clean and sanitary manner and are provided with cold running water under pressure, soap, approved hand drying devices, and are available during all hours of operation. The Petitioner shall also ensure that directional signage is installed within or outside the establishment clearly stating the location of the bathrooms. If the ownership of Montoya Holdings Inc. (Healthy Children Catering) and/or Doctors Metales changes, an updated signed agreement for use of the bathroom facilities will be required immediately

- a permanent waiver of paragraph 11B-27.002(4), F.A.C., from Chief Gerard DeCanio of the City of Port Richey Police Department on behalf of Kenneth Korchak, Jr.Petitioner wishes to permanently waive that portion of the Rule that states: Within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment, and certification as an officer. Petitioner states that, between August 20, 2012, and May 25, 2013, Mr. Korchak successfully completed a Commission-approved Basic Recruit Training Program and received a passing score. Petitioner further states that on May 29, 2013, Mr. Korchak achieved a passing score on the State Officer Certification Examination. Mr. Korchak then sought employment with Petitioner, completing a majority of the pre-employment screening. According to Petitioner, changes in command staff led to the failure of Petitioner to change Mr. Korchak’s employment status prior to Mr. Korchak’s August 20, 2016, hiring deadline. The Petitioner asserts that Mr. Korchak would suffer an economic hardship should the waiver not be granted, as Mr. Korchak would, through no fault of his own, be required to forego employment and pay for and complete a training program, the State Officer Certification Examintion, and a second pre-employment screening.

- On December 20, 2016, the Division issued an order. The Final Order was in response to a Petition for an emergency permanent Variance from H.L Culbreath Bayside Power Station, filed September 20, 2016, and advertised on September 26, 2016, in Vol. 42, No. 187, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 4.1.1, A.S.M.E. A17.1, 2009 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code that requires single-section horizontally swinging landing doors because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2016-220).

The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink.
The Division of Hotels and Restaurants will accept comments concerning the Petition for 14 days from the date of publication of this notice. To be considered, comments must be received before 5:00 p.m.
