- of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on December 11, 2019, by Shawn D. Westbrook, O.D. Petitioner was seeking a waiver or variance from Rule 64B13-4.001(1), F.A.C., entitled, “Examination Requirements” that states an applicant for licensure must achieve a passing score on all four (4) parts of the licensure examination in order to be licensed in Florida. The Notice was published in Volume 45, No. 243, of the Florida Administrative Register, on December 17, 2019.
The Board considered the instant Petition at a duly-noticed meeting held January 17, 2020, in Orlando, Florida. The Board’s Order, filed on February 11, 2020, granted the petition finding that Petitioner had established that the purpose of the underlying statute would be met by granting a variance or waiver from Rule 64B13-4.001(1), F.A.C. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to his circumstances would violate principles of fairness and impose substantial hardship.

The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers and employees and the requirement that at least one service sink is provided for the cleaning of mops or similar cleaning tools and the disposal of mop water. They are requesting to share the bathrooms located within a nearby establishment under a different ownership for use by customers and employees and to utilize the mopsink located within another business under a different ownership.
The Division of Hotels and Restaurants will accept comments concerning the Petition for 5 days from the date of publication of this notice. To be considered, comments must be received before 5:00 p.m.
- an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2017 FDA Food Code from GUACAMOLITO BAR LLC located in Hialeah. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash and 3-compartment sinks.
The Division of Hotels and Restaurants will accept comments concerning the Petition for 5 days from the date of publication of this notice. To be considered, comments must be received before 5:00 p.m.

- The Florida Department of Transportation (FDOT) will hold a public hearing regarding proposed safety improvements on U.S. 441 at Blanton Lane and Hilltop Road. Proposed improvements consist of converting the full median openings at Blanton Lane and Hilltop Road to bi-directional openings. These changes will allow eastbound traffic on U.S. 441 to make a left turn onto Three Lakes Park, and westbound traffic to make a left turn onto Hilltop Road and Blanton Lane. Traffic from Blanton Lane, Hilltop Road and Three Lakes Park will only be able to turn right onto U.S. 441. These safety improvements will help reduce the number of conflict points at these intersections.
The public hearing will be Thursday, March 5, 2020, at the Activity Center at First United Methodist Church of Tavares, 601 N. Barrow Avenue, Tavares, FL 32778. The hearing will begin as an informational open house at 5 p.m. where displays and other project information will be available for review. Staff also will be available to discuss the project and answer questions. A presentation will begin at 6 p.m., followed by public comments.
A court reporter will be present to record proceedings, and assist with comments, as part of the project record. Written comments can be submitted at the hearing, sent by mail to Dave Mixon, Florida Department of Transportation, 719 S. - Fred Shuaibi; The Notice of Petition for Declaratory Statement was published in Volume 45, No. 222, of the November 14, 2019, Florida Administrative Register. The Petitioner sought a Declaratory Statement from the Board with regard to Rule 61G6-7.001, F.A.C. and whether the following listed activities are within the practice of a sign specialty contractor’s license.
a. Can a sign specialty contractor connect to an existing dedicated circuit near the pole sign (free standing panel)?
b. Can a sign specialty contractor test that existing dedicated free standing panel and determine if it is adequate to energize the free standing sign?
c. Can a sign specialty contractor acquire a permit to stub out free standing sign conduit to that existing dedicated circuit or Brooks box?
The Electrical Contractors’ Licensing Board considered the Petition at a duly-noticed public meeting held on January 24, 2020, in Fernandina Beach, Florida The Board, in the Order filed on February 10, 2020, voted to answer the questions in the following manner:
a. Yes, a sign contractor can connect to a nearby pole. However, the Board was unsure of what Petitioner was describing as “free standing” an so the Board cannot opine or provide a specific answer.
b. The Board was unable to answer this question because it was too vague.
c. The Board stated that permitting is up to the local jurisdiction.

- Grayscale Partners, LLC; Petitioner requested an answer to the following questions, based upon the project described within its petition: 1. Do the dwelling units in Project A meet the definition of townhouse under the Florida Building Code? 2. Do the dwelling units in Project B meet the definition of townhouse under the Florida Building Code? 3. Do the dwelling units in Project C meet the definition of townhouse under the Florida Building Code? 4. If the answer is yes to one or more of the above questions, does it follow that the townhouses in that project are subject to the Florida Building Code, Residential, and therefore not subject to the Florida Building Code, Building?
On February 11, 2020, the Commission provided the following answers:
For questions one through three, the answer to each is no. Each project in question does not meet the fire separation requirements of sections R302.1, R302.2 and R302.2.1 of the Florida Building Code, Residential, 6th Edition (2017), which require that each townhouse be considered a separate building and be separated by a separate and continuous fire rated wall assembly meeting the requirements of zero clearance from property lines of section R302.1, Florida Building Code, Residential, 6th Edition (2017), for exterior walls. Since the answers to questions one through three were all no, Petitioner’s fourth question does not require an answer.

When the gate latch is located at least 54 inches from the bottom of the gate, is a barrier that has no opening greater than ½ inch (12.7 mm) within 18 inches (457 mm) of the release mechanism still required? 2. If a magnetic top pull latch is installed at least 54 inches from the bottom of the gate, can the release mechanism and the self-latching locking device both be located on the outside of the gate?
On February 11, 2020, the Commission provided the following answers: In response to Petitioner’s first question, the answer is yes. Pursuant to section R4501.17.1.8, Florida Building Code, Residential, 6th Edition (2017), the gate and the barrier in question must have no opening greater than 1/2 inch (12.7 mm) within 18 inches (457 mm) of the release mechanism. In repose to Petitioner’s second question, the answer is no. Pursuant to section R4501.17.1.8, Florida Building Code, Residential, 6th Edition (2017), the self-latching locking device for the project in question must be located on the pool side of the gate and the release mechanism may be located on either side of the gate.
