- On February 13, 2018 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from HM Retail LLC located in Wellington. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink and the three compartment sink.
The Petition for this variance was published in Vol. 44/31 on February 14, 2018. The Order for this Petition was signed and approved on February 21, 2018. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the handwash sink and the three compartment sink is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash sink and the three compartment sink is provided with hot and cold running water under pressure, and that the handwash sink is provided with soap, an approved hand drying device and a handwashing sign.
- On February 2, 2018 the Division of Hotels and Restaurants received a Petition for a Routine Variance for Subparagraph 3-305.11(A)(2), 2009 FDA Food Code, Section 3-305.14, 2009 FDA Food Code, Section 6-202.15, 2009 FDA Food Code, Section 6-202.16, 2009 FDA Food Code, Paragraph 61C-4.010(1), Florida Administrative Code, and Paragraph 61C-4.010(6), Florida Administrative Code from Janed's Catering located in Orlando. The above referenced F.A.C. addresses the requirement for proper handling and dispensing of food. They are requesting to dispense bulk time/temperature control for safety foods from an open air mobile food dispensing vehicle.
The Petition for this variance was published in Vol. 44/24 on February 5, 2018. The Order for this Petition was signed and approved on February 21, 2018. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring that each pan within the steam table is properly covered with an individual lid; the steam table is enclosed within a cabinet with tight-fitting doors, and is protected by an air curtain installed and operated according to the manufacturer’s specifications that protects against flying vermin or other environmental contaminants; all steam table foods must be properly reheated for hot holding at approved commissaries and held hot at the proper minimum temperature per the parameters of the currently adopted FDA Food Code; and steam table food is to be dispensed by the operator with no customer self-service. The Petitioner shall also strictly adhere to the operating procedures and copies of the variance and operating procedures are to be present on the MFDV during all periods of operation.

- Of the issuance of an Order granting the petition for Variance or Waiver, filed on December 12, 2017, by Karina Barro. The Notice of Petition for Waiver or Variance was published in Vol. 44, No. 06, of the Florida Administrative Register. No comments were received in response to the petition. Petitioner sought a variance or waiver from the 1.5 hour per week of face-to-face interactive supervision requirement of Rule 64B21-500.005, F.A.C. The Department’s Order, filed on February 21, 2018, granted the Petitioner’s request because Petitioner demonstrated that she complied with the underlying statute requiring an applicant for a school psychology license to have a minimum of three years of experience in school psychology, two of which with 1.5 hours per week of face-to-face interactive supervision.

At this Open House transportation officials will provide updates and information from the following organizations including the Florida Department of Transportation, the Heights Mobility Study, the Regional Transit Feasibility Plan, City of Tampa Streetcar Study, Hillsborough County Metropolitan Planning Organization Long Range Transportation Plan, improvements proposed for the Downtown Tampa Interchange and I-275 North and other transportation related topics. The format will encourage open dialogue to provide information, address questions and ideas. - The Florida Department of Transportation (FDOT), District 5, is hosting a public meeting for improvements to the Rinehart Road and County Road (C.R.) 46A intersection. The project will help make traffic flow more smoothly and safely in the area near the Interstate 4 and C.R. 46A interchange. The project will eliminate all left turns across oncoming traffic at the C.R. 46A and Rinehart Road intersection. Instead, motorists will use new signalized “mid-block U-turns” on Rinehart Road, located about 500 feet north and south of the C.R. 46A intersection, to head in their desired direction. At the meeting, maps, drawings and other important information will be available for public review. The meeting will have an open house format, where participants can visit any time between 5:00 p.m. and 8:00 p.m. FDOT staff and others associated with the project will be available to discuss the project and answer questions. Attendees will have the opportunity to ask questions regarding the construction. There will not be a formal presentation. Participants may provide public comments directly to public communication staff at any time during the meeting. Written comments from all interested parties will be accepted by the department at the public meeting and for a period of ten (10) days after the public meeting. Comments should be addressed to: J.
