- The purpose of this rule revision is to provide guidance relating to the statewide public school student progression law eliminating social promotion by reducing the number of examples per benchmark required for the third grade portfolio, align the criteria for the portfolio to the new FCAT Item Specifications, and eliminating the reference to SAT-9.
Most recently, the Florida Comprehensive Assessment Test (FCAT) was revised to align with the current Next Generation Sunshine State Standards. Due to this revision, Rule 6A-1.094221, F.A.C., will need revisions to align to the new FCAT 2.0. The grade 3 FCAT Item Specifications document was used to revise the existing State Board Rule to properly align to FCAT 2.0. The revisions include the following:
• An increase in the average passage length from 350 to 500 words
• A change in the score for demonstrating proficiency for each benchmark from a grade of C or better to a grade of 70% or better.
Due to the number of benchmarks that are now assessed on FCAT 2.0, the rule as it exists would require 5 examples per benchmark for completion of the portfolio, equaling 70 samples of student work from one student to demonstrate proficiency of third grade benchmarks. This is a drastic increase, from 40 to 70 samples, and unrealistic expectations for students. This will cause loss of instructional time for our most struggling students. Therefore, a reduction of the number of examples required for the third grade student portfolio is proposed.
In addition, the Stanford Achievement Test, 9th Edition (SAT-9) is no longer provided by the publishing company, and therefore reference to SAT-9 needs to be stricken from rule.
- The purpose of this rule revision is to align the criteria for the mid-year portfolio to the new FCAT Item Specifications.
Most recently, the Florida Comprehensive Assessment Test (FCAT) was revised to align with the current Sunshine State Standards. Due to this revision, Rule 6A-1.094222, F.A.C., will need revisions to align to the new FCAT 2.0. The grade 4 FCAT Item Specifications document was used to revise the existing State Board Rule to properly align to FCAT 2.0.
The revisions include the following:
• Reference to short and extended responses was stricken from rule
• An increase in the average passage length from 375 to 500 words
• A change in the score for demonstrating proficiency for each benchmark from a grade of C or better to a grade of 70% or better.
- The purpose of this rule revision is to update and align the criteria for reading intervention placement with current research, include professional development offerings that will be available to content area reading intervention teachers in 2011, and provide greater flexibility to districts in meeting student reading needs. A change is proposed in the criteria established for determining placement of students in reading intervention at the secondary level as new research suggests that fluency is not a strong predictor of a student’s ability to comprehend text in middle grades and high school. Also, in 2011, new professional development will be provided for content area reading intervention teachers, called Next Generation Content Area Professional Development (NGCAR-PD).
Finally, additional flexibility is requested for districts in scheduling additional time for reading intervention.
Finally, language was revised to allow flexibility to districts regarding progress monitoring requirements of Level 1 and 2 students to protect instructional time. With the rule revision it allows flexibility for administering a progress monitoring tool at the end of the school year.
- The purpose of the rule development is to delineate the professional development package designed to provide information that content area teachers need to become proficient in applying scientifically based reading strategies through their content areas, pursuant to Section 1003.413(4)(b), F.S. The effect of the rule will be the provision of professional development that will, upon its completion, allow content area teachers to effectively deliver reading intervention to students who score at level 2 in reading on the Florida Comprehensive Assessment Test (FCAT) and do not need instruction in decoding and text reading efficiency.
- The purpose of this rule development is to update language, provide clarity regarding fidelity of program implementation, include the new Next Generation Content Area Professional Development (NGCAR-PD) package to align to the proposed changes to State Board Rule 6A-5.090, F.A.C., Content-Area Reading Professional Development, and revise fluent and disfluent language to align to the proposed changes to State Rule 6A-6.054, F.A.C., Student Reading Intervention. It is proposed that the language fluent and disfluent be stricken from the reading intervention and K-12 Plan rules as new research suggests that fluency is not a strong predictor of a student’s ability to comprehend text in middle grades and high school.

- That on January 14, 2011, the Florida Department of Business and Professional Regulation, Division of Hotels and Restaurants received a Petition for a Routine Variance on December 10, 2010 for paragraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2001 FDA Food Code from Curbside Cafe located in Boca Raton. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater.
The Petition was published in Vol. 36/52 on December 30, 2010 and after a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the three-compartment and handwash sinks are emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. Petitioner shall also ensure that the three-compartment and handwash sinks are provided with hot and cold running water under pressure; and the handwash sink is provided with soap, approved hand drying devices and a handwashing sign.

- That the Bureau issued an order granting a variance to Bruce Leeds regarding PB-988, an application to construct a major habitable structure. The petition for variance was received on July 20, 2010. Notice of receipt of petition requesting variance was published in the F.A.W. Vol. 36, No. 31, on August 6, 2010. No public comment was received. The petition was approved on January 20, 2011. This Order grants a variance from subsection 62B-33.005(8), F.A.C., which requires that major structures be located a sufficient distance landward of the frontal dune. The petitioner was able to demonstrate that strict adhearance to the rule would create a substantial hardship, violate the principles of fairness, and that the underlying statute’s purpose will be or has been achieved by other means. The property is located at 4205 S. Ocean Blvd., Highland Beach, Palm Beach Co.

The Board considered the Petition at a duly-noticed public meeting held on December 3, 2010. The petition requested a waiver or variance from the requirement imposed by Rule 64B5-2.0146, F.A.C., with respect to the following licensure requirement: that each applicant for a Florida dental license successfully completes supplemental remedial education to the level of a graduation senior.
The Board’s Order, filed on December 23, 2010, grants the Petition for Variance or Waiver, finding that Petitioner has complied with the requirements of Section 120.542(2) of the Florida Statutes. Specifically, Petitioner has demonstrated how the purpose of the underlying statute would be achieved or has been achieved by other means as evidenced through his supplemental studies, and practice experience. - Of the issuance of an Order regarding the Petition for Variance filed by Richard Kaplan, D.D.S., filed on July 26, 2010. The Notice of Petition for Variance was published in Vol. 36, No. 32, of the August 13, 2010, Florida Administrative Weekly. The Board considered the Petition at a duly-noticed public meeting held on September 17, 2010. The petition requested a waiver or variance from the requirement imposed by paragraph 64B5-2.013(3)(c), Florida Administrative Code, that each applicant for a Florida dental license successfully comply all thee examinations as provided in Section 466.006, Florida Statutes, within a 13 month period to qualify for licensure.

The Board considered the Petition at a duly-noticed public meeting held on September 17, 2010. The petition requested a waiver or variance from the requirement imposed by paragraph 64B5-2.0135(1)(a), F.A.C., as to an applicant for a Florida dental license must successfully complete all portions of the examination within a thirteen month period in order to qualify for licensure.

No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a permanent variance from subparagraph 64E-16.004(2)(d)3., Florida Administrative Code, which requires reusable sharps containers shall be emptied into a treatment cart or directly into the treatment unit. The Petitioner has demonstrated that the purpose of the statute underlying the rule will be met and that Petitioner would suffer a substantial hardship if required to comply with this rule.

- On January 13, 2011, the District Governing Board issued SFWMD Order No. 2011-008-DAO-ROW was issued to Granada Estates Homeowners Association (Application No. 10-1104-1). The petition for waiver was received by the District on November 4, 2010. Notice of receipt of the petition requesting the waiver was published in the Florida Administrative Weekly, Vol. 36, No. 47, on November 24, 2010. No public comment was received. This Order provides a waiver of the District’s criteria to allow a proposed cross-fence with a 36'' wide pedestrian passthru and a 16' double wide vehicular access gate within the C-103S north right of way; Section 17, Township 57 South, Range 39 East, Miami-Dade County. Specifically, the Order grants a waiver from paragraph 40E-6.221(2)(j), Fla. Admin. Code, and the Basis of Review for Use or Occupancy of the Works or Lands of the District, incorporated by reference in subsection 40E-6.091(1), F.A.C., which prohibits the placement of permanent and/or semi-permanent above-ground facilities within 40 feet of the top of the canal bank within works of lands of the District. Generally, the Order sets forth the basis of the Governing Board decision to grant the waiver, as follows: 1) the facilities will not significantly interfere with the District’s current ability to perform necessary construction, alteration, operation, and routine maintenance activities; and 2) the Order granting a waiver from the subject rule is based upon a substantial hardship.
- On January 13, 2011, the District Governing Board issued SFWMD Order No. 2011-009-DAO-ROW to Palm Beach County (Application No. 10-0128-1). The petition for waiver was received by the District on August 6, 2010. Notice of receipt of the petition requesting the waiver was published in the Florida Administrative Weekly, Vol. 36, No. 34, on August 27, 2010. No public comment was received. This Order provides a waiver of the District’s criteria to allow for the relocation of a high mast street light, mast arm traffic signalization pole and associated above ground pull boxes located with the northeasterly bridge quadrant in conjunction with the SR7/US441 bridge widening crossing the C-51 Canal; Section 36, Township 43 South, Range 41 East, Palm Beach County. Specifically, the Order grants a waiver from subsections 40E-6.011(4) and (6), F.A.C., and the Basis of Review for Use or Occupancy of the Works or Lands of the District, incorporated by reference in subsection 40E-6.091(1), F.A.C., which prohibits the placement of permanent and/or semi-permanent above-ground facilities within 40 feet of the top of the canal bank and within the District’s designated 100 foot long equipment staging areas located at all bridge and ile-supported utility crossings within works of lands of the District. Generally, the Order sets forth the basis of the Governing Board decision to grant the waiver, as follows: 1) the facilities will not significantly interfere with the District’s current ability to perform necessary construction, alteration, operation, and routine maintenance activities; and 2) the Order granting a waiver from the subject rule is based upon a substantial hardship.

- As part of the Regional Mobility Plan, the Capital Region Transportation Planning Agency (CRTPA) is developing a Trails and Greenways Master Plan. This plan focuses on improvements needed to provide a comprehensive, connected and accessible trail and greenway system throughout Gadsden, Wakulla, Jefferson and Leon counties. Emphasis will be placed on developing interconnected hard-surface trails to popular destinations such as schools, parks, shopping and employment centers.

The Florida Land and Water Adjudicatory Commission will take action on matters duly presented on its agenda including appeals of local government development orders in areas of critical state concern or of developments of regional impact under Section 380.07, F.S.; and review of water management matters under Chapter 373, F.S. The Commission will also review Department of Environmental Protection’s rules and orders which, prior to July 1, 1993, the Governor and Cabinet, sitting as the head of the Department of Natural Resources, had authority to issue or promulgate.
The Board of Trustees of the Internal Improvement Trust Fund will take action on matters duly presented on its agenda which may include such matters as mineral leases or sales, state or sovereign land leases, sales, exchanges, dedications, and easements, Conservation and Recreation Lands (CARL) and other land purchases; land planning matters and other matters within its authority.
