- On March 8, 2016, the Department issued a Final Order that was in response to a Petition for Variance from Commander Apts, filed February 16, 2016, and advertised on February 22. 2016 in Vol. 42, No.35, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance denies the Petitioner a variance from Rule 2.7.4.1, ASME A17.1b, 2009 edition, as adopted by 61C-5.001(1), Florida Administrative Code that states the minimum headroom requirement in the machine room. Petitioner has not demonstrated that the purpose of the underlying statute has been met. Granting of this variance would create a dangerous precedent and the proposed restricted use is not consistent with the principle of public safety articulated by the Rules. (VW 2016-035)

Notice of receipt was published in the Florida Administrative Register on December 17, 2015; Vol. 41/243. The Petitioner requested a variance or waiver from Rules 62B-33.002(18), 62B-33.002(43), and 62B-33.0051(1)(a)1, F.A.C., which requires that in order to qualify for a permit for coastal armoring, the structure proposed to be protected must be an eligible structure. No public comment was received. The Order, file number FR-925 AR V, granted the Petitioner a variance from rules 62B-33.002(18), 62B-33.002(43), and 62B-33.0051(1)(a)1, F.A.C., based on a demonstration by the Petitioner that he would suffer a substantial hardship if the variance or waiver was not granted.

- The Department of Economic Opportunity (DEO) announces two public meetings to review the draft Annual Action Plan that will be submitted to the U.S. Department of Housing and Urban Development. The first meeting is a public workgroup meeting on March 23, 2016, 2:00-4:00 p.m. The second meeting is a Public Hearing on the draft Annual Action Plan on April 22, 2016, from 2:00-4:00 p.m.
PURPOSE: To discuss the preparation of the Annual Action Plan for Federal Fiscal Year 2016 and to review the draft of the Action Plan once it is completed.
SUMMARY: The State of Florida is required to submit an Annual Action Plan to the U. S. Department of Housing and Urban Development (HUD) in order to receive federal funding from that agency. The Plan must cover the grant programs funded by HUD. Grant programs included in the Plan are administered by four state agencies: the Florida Small Cities Community Development Block Grant (CDBG) by the Department of Economic Opportunity; the Emergency Solutions Grant (ESG) by the Department of Children and Families; the Home Investment Partnership (HOME) by the Florida Housing Finance Corporation; and the Housing Opportunities for Persons with Aids (HOPWA) by the Department of Health. The Plan must specify the manner in which the funds will be distributed to eligible applicants.
ACTION TO BE TAKEN: At the work group meeting to be held on March 23, 2016, staff from the CDBG, ESG, HOME and HOPWA programs will provide an overview of the programs and answer questions. Interested parties are encouraged to attend. Another public meeting will be conducted on April 22, 2016, to review and accept comments on the draft Annual Action Plan. The draft of the Plan will also be posted on the Department’s website: http://www.floridajobs.org/Annual-Action-Plan. The 30-day comment period on the drafted plan will commence on March 23, 2016, and will conclude April 22, 2016.; March 23, 2016, 2:00 p.m. to 4:00 p.m.
