- On March 14, 2013 the Division issued an order. The Final Order was in response to a Petition for an emergency Variance from Camping World, filed February 27, 2013, and advertised on March 1, 2013 in Vol. 31, No. 13, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 2.2.2.4, 2.2.2.5, and 2.2.2.6 ASME A17.1b, 2009 edition, as adopted by Chapter 30, Section 3001.2 Florida Building Code adopted by Rule 61C-5.001(1)(a) Florida Administrative Code that requires upgrading the elevators sump pump because the Petitioner has demonstrated that the intent of the rule will be met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2013-061).
- On March 14, 2013, the Department issued a Final Order that was in response to a Petition for Variance from Ponce De Leon Hall, filed February 18, 2013, and advertised on February 21, 2013 in Vol. 39, No. 36, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance denies the Petitioner a variance from Rule 2.7.1, 2.7.1.1, 2.7.1.1.2, 2.7.1.2.1 and 110.1, ASME A17.1, 1996 edition, and 17.1b, 2009 edition as adopted by 61C-5.001(1)(a), Florida Administrative Code that requires upgrading the elevators venting of hoistways, enclosure of rooms an spaces, fire-resistive construction, non-fire-resistive construction and entrances and emergency doors required because no effective means of meeting intent of code. Situation was created as a result of unpermitted alterations that did not meet code or that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2013-057).

- Jessica D. Smith; The Notice of Petition for Declaratory Statement was published in Volume 39, No. 10, of the July 13, 2012, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on February 8, 2013. The Petitioner did not state in her request which statute the Petitioner was seeking the Board to interpret. However, it appeared that Petitioner was requesting and interpretation of Chapter 486.021, Florida Statutes, and whether staple removal is within the scope of practice for physical therapist assistants.
The Board’s Order, filed on march 4, 2013, denies the Petition for Declaratory Statement. The Petition is asking for clarification of the statutory provisions and rules to determine conduct that has general applicability to all physical therapist assistants. This type of clarification in not appropriate for determination by declaratory statement.
