General Basis for Agency Decision: The Petitioner demonstrated that the use of smaller signs on Weedon Island Preserve Paddling Trail will still ensure waters of the state are marked in such a manner as to promote safe navigation on Florida’s waterways, the purpose of the rule and the statutes it implements. The Petitioner further demonstrated that if the request for a variance is denied, they will face substantial financial hardship associated with purchasing and installing the more expensive, larger signs.

The Petition for Variance or Waiver was filed by Monica Rita Cotik-Bilsky, on January 24, 2019, seeking a variance or waiver of Rule 64B17-3.001(3)(c)2.a., F.A.C., by requesting that the Equivalence Credential Evaluation Report performed by IERF be accepted by the Board as meeting the requirement of the licensure rule for foreign trained applicants. The Board considered the Petition at a duly-noticed public meeting held on February 15, 2019, in Tampa, Florida, and granted Petitioner’s motion to modify the Petition. At its meeting, the Board granted the modified Petition finding that Petitioner demonstrated that the purpose of the underlying statute has been achieved by other means; has demonstrated a hardship; and has demonstrated that the principles of fairness would be violated. Specifically, the Order grants a variance or waiver of Rule 64B17-3.007(2)(g), F.A.C., and permits the Petitioner to use copies of transcripts and educational documents for evaluation of foreign education credentials for licensure as a physical therapist.

- Al-Farooq Corporation; Petitioner requested an answer to the following question, based upon the project described within its petition: Given that it is likely that ASTM E1996-17 will be incorporated into future versions of the Florida Building Code, and since this product revision implies that it is not a structural issue for this type of substitution, is it acceptable to follow the new exemption in ASTM E1996-17 section A1.9.2 for spacers, even though chapter 35, Florida Building Code, 6th Edition (2017), currently only lists ASTM E1996-05, 06, 09, 2012a, or 2014a as reference standards? ? On February 19, 2019, the Commission provided the following answer: pursuant to rule 61G20-3.015(5), ASTM E1996-2017 is permitted to be used to update the current product approval for FL 28367 as long as the said standard is certified by an approved entity (i.e. an approved certification agency, an approved test lab, an approved evaluation entity, a Florida licensed professional engineer or architect, or a nationally recognized standard writing organization) as meeting or exceeding the performance of the standard referenced by the Florida Building Code, 6th Edition (2017) (in this case, ASTM E1996-05, 06, 09, 012a, or 014a).

Is section 1607.8.1 the applicable section of the Florida Building Code for the design of a glass handrail and guards assembly in an interior installation? 2. Since the project is located within the High Velocity Hurricane Zone, is section 1618.4.6.3 the applicable section of the Florida Building Code for the design of a glass handrail and guards assembly in an interior installation?
On February 19, 2019, the Commission provided the following answers: In response to Petitioner’s question 1, the answer is yes. However, in addition to meeting the design requirements of section 1607.8.1, Florida Building Code, Building, 6th Edition (2017), the interior glazed handrails/guards in question must also meet the applicable requirements of chapter 24 of the Florida Building Code, Building, 6th Edition (2017). In response to Petitioner’s question 2, the answer is no. Section 1618.4.6.3, Florida Building Code, Building, 6th Edition (2017) pertains to wind resistance requirements and does not apply to the interior glazed handrails/guards in question.
