- that on April 16, 2013, the Department issued an order denying a variance to Petitioner, Appalachian Material Service, Inc related to the land application of biosoilds at their JMC Biosolids Land Application Site (located on Alturas-Babson Park Cutoff and East of Lake Buffum Road). On September 10, 2012, the Department received a petition for a variance from the provisions of subsection 62-640.700(6)(b), F.A.C., which requires that alkaline treated biosolids must be applied by the Best Management Practice of incorporation or injection unless it is applied at a distance greater than one-quarter mile from the site property line. This distance can be reduced under the rule if written consent is obtained from the affected adjacent property owners. Notice of receipt of this Petition was published in the Florida Administrative Register on October 1, 2013. No public comment was received. The Order, OGC No.: 12-1486; Site No: FLA290386, denied the Petition because the Petitioner failed to demonstrate that a strict application of the rule would result in substantial hardship to Petitioner or would affect Petitioner differently than other similarly situated applicants and because Petitioner failed to demonstrate that the purpose of the underlying statute will be or has been achieved by other means.

- a permanent waiver of Rule 11B-27.00212(6), F.A.C., from the Florida Fish and Wildlife Conservation Commission (FFWCC) on behalf of Investigator John E. Brown for the period July 1, 2000, to June 30, 2012. The Petitioner wishes to waive that portion of the rule that requires an officer to become automatically separated from employment and the officer’s certificate to become inactive if the employing agency does not file the Mandatory Retraining Report form CJSTC 74 by the June 30 deadline. The Petitioner further wishes to waive that portion of the rule that requires a full background check be conducted on an officer separated under the operation of the rule before the officer’s certification can be reactivated by his employer and his training records can be re-entered into the Commission’s Automated Training Management System (ATMS). The Petition supports the requested waiver by stating that Investigator Brown has been continuously employed by FFWCC since April 6, 1987. Investigator Brown was inadvertently separated from FFWCC in ATMS on July 7, 2000, through a clerical error. He was continually employed by FFWCC during that time and to the present. Investigator Brown completed all of his mandatory retraining required for the reporting periods between July 1, 2000, and June 30, 2012, however, FFWCC cannot produce the required Mandatory Retraining Report form CJSTC 74 for any of the reporting periods. The Petition states that the Petitioner and Investigator Brown will suffer substantial hardship if the rule waiver is not granted because Investigator Brown’s certification will become inactive and FFWCC must then conduct a full background investigation on Investigator Brown before his certification can be reactivated. The Petition states that these consequences will violate the principles of fairness by subjecting Petitioner and Investigator Brown to consequences that others subject to the rule do not face.

- a permanent waiver of Rule 11B-27.013(2) and (5), F.A.C., by Bradford County Sheriff’s Office on behalf of Sergeant Lee Gartno and K-9 Bara. The rule requires canine teams to complete 400 hours of instruction prior to certification and to successfully complete an addition 40 hours recertification course. The Petition supports the waiver by asserting that the K-9 team did, indeed, complete all course work required for certification on December 6, 2011, and completed all course work for re-certification on December 13, 2012. The Petition states that a form CJSTC 70 was filed in both instances. However, a review of the forms revealed that they were not signed by the evaluator, as required. During all times pertinent to this rule waiver request, the K-9 team was actively deployed. The Petition states that the application of the rule in this case would create a substantial hardship for the agency and the K-9 team by taking the team off of patrol and forcing the team to go through evaluation again, which it has already successfully completed. The Petition further states that the application of the rule in this case would violate the principles of fairness in that the rule applies to the Petitioner and the K-9 team in a way that it does not apply to other, similarly situated, agencies and teams. The rule would sideline Petitioner’s K-9 team for a clerical error, whereas other teams affected by the rule would be inactivated for failure to train, which Petitioner states was not the case in this instance as the paperwork shows.

This public hearing is being conducted to give interested persons an opportunity to express their views concerning the location, conceptual design, and social, economic, and environmental effects of the proposed improvements and in accordance with Federal Executive Orders 11990 and 11988. The purpose of this study is to design a transportation system that will offer new commuting choices and more reliable travel during congested periods with the implementation of an express lanes system. This study is focusing on evaluating the addition of tolled express lanes in the median. The purpose of these express lanes is to improve mobility, relieve congestion and provide additional travel options along the I-95 corridor. The express lanes will create an opportunity to accommodate a Bus Rapid Transit (BRT) system that will allow express bus service between counties with connections to the existing Park-and-Ride lots along the corridor. This project will provide continuity with the proposed I-95 express lanes system immediately to the south of the study limits, as well as to the existing I-95 express lanes system in Miami-Dade County. The bridges over the Hillsboro Canal will be replaced as part of this project in order to accommodate the proposed corridor improvements.
