- The Department is initiating rulemaking to establish Total Maximum Daily Loads (TMDLs) for certain surface waters in the basins listed above where those waters previously have been identified as impaired for specific pollutants and included on the Department’s verified list of impaired waters. Pursuant to Section 403.067(6), F.S., TMDLs must be adopted in rule by the Secretary of the Department. Chapter 62-304, F.A.C., was established as the rule chapter within which rules adopting TMDLs shall reside. Furthermore, in accordance with paragraph 62-302.531(2)(a), F.A.C., any of these rules which establish nutrient TMDLs, if adopted, are intended to constitute site specific numeric interpretations of the narrative nutrient criterion set forth in paragraph 62-302.530(47)(b), F.A.C. that will supersede the otherwise applicable numeric nutrient criteria in rule 62-302.531 for the particular surface water segment.

- On April 2, 2015 the Division issued an order. The Final Order was in response to a Petition for a Variance from Ocean Residences @ Boca Bch Club Condo Assoc. Inc., filed March 11, 2015, and advertised on March 13, 2015 in Vol. 41, No. 50, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 2.7.4 ASME A17.1b, 2005 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code from the requirement for a minimum clearance of 84 inches in the machine space within the machine room because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2015-059).
- On April 2, 2015 the Division issued an order. The Final Order was in response to a Petition for an emergency Variance from B112 at Universal Studios, filed March 24, 2015, and advertised on March 27, 2015 in Vol. 41, No. 60, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 2.4.1.5 and 2.15.9.2 ASME A17.1b, 2009 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code from the requirement that the pit be 5’ deep, and are seeking permission to use a retractable toe guard for the existing 4’ pit because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2015-0076).
- Eglin Federal Credit Union. Petitioner seeks an emergency variance of the requirements of an unspecified Section of A17.3, as adopted by 61C-5.001(1), Florida Administrative Code that requires upgrading the elevators operations which poses a significant economic/financial hardship. Any interested person may file comments within 5 days of the publication of this notice with Michelle Comingore, Bureau of Elevator Safety, 1940 North Monroe Street, Tallahassee, Florida 32399-1013 (VW2015-086).
- Shell Point Retirement-Coquina. Petitioner seeks an emergency variance of the requirements of ASME A17.1, Section 2.4.1.5 and 2.15.92, as adopted by 61C-5.001(1), Florida Administrative Code to request the use of a retracting toe guard which poses a significant economic/financial hardship. - of the issuance of an Order regarding the Petition for Variance or Waiver, filed on February 6, 2015, by Ronald Clark. The Notice of Petition for Waiver or Variance was published in Vol. 41, No. 33, of the February 18, 2015, Florida Administrative Register. Petitioner sought a waiver or variance of Rule 61G4-16.005 Florida Administrative Code, which requires for the purpose of certification, a passing grade shall be valid only for a period of four (4) years from the date the list of successful candidates is approved by the Board. The Board considered the instant Petition at a duly-noticed public meeting held on March 13, 2015, in Altamonte Springs, Florida.
The Board’s Order, filed on March 30, 2015, denied the petition finding that the Petitioner has not demonstrated how the purpose of the underlying statute will be or has been achieved by other means by the Petitioner. In addition, the Petitioner has not shown how application of the rule creates a substantial hardship or violates principles of fairness.

The petition seeks a declaratory statement Sections 489.105 and 489.103, Florida Statutes, as to whether a contract or electrical or low voltage work can be awarded to a "general contractor," provided the general contractor subcontract the work to an appropriately licensed electrical or low voltage subcontractor.
