- a Routine Variance for Paragraph 4-301.12(A), 2009 FDA Food Code and Paragraph 61C-4.010(5), Florida Administrative Code from Courtside Deli located in Orange Lake. The above referenced F.A.C. addresses the requirement that dishwashing facilities for manually washing, rinsing and sanitizing equipment and utensils are provided. They are requesting to share the three-compartment sink located within an adjacent business under the same ownership.
The Division of Hotels and Restaurants will accept comments concerning the Petition for 14 days from the date of publication of this notice. To be considered, comments must be received on or before 5:00 p.m.
- On April 24, 2014 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 3-305.11(A)(2), 2009 FDA Food Code, Section 3-305.14, 2009 FDA Food Code, Section 6-202.15, 2009 FDA Food Code, Section 6-202.16, 2009 FDA Food Code, Paragraph 61C-4.010(1), Florida Administrative Code, and Paragraph 61C-4.010(6), Florida Administrative Code from Hernandez Taco Express MFDV located in Hialeah. The above referenced F.A.C. addresses the requirement for proper handling and dispensing of food. They are requesting to dispense bulk time/temperature control for safety foods from an open air mobile food dispensing vehicle.
The Petition for this variance was published in Vol. 40/82 on April 28, 2014. The Order for this Petition was signed and approved on May 07, 2014. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring that each pan within the steam table is properly covered with an individual lid; the steam table is enclosed within a cabinet with tight-fitting doors, and is protected by an air curtain installed and operated according to the manufacturer’s specifications that protects against flying vermin or other environmental contaminants; all steam table foods must be properly reheated for hot holding at approved commissaries and held hot at the proper minimum temperature per the parameters of the currently adopted FDA Food Code; and steam table food is to be dispensed by the operator with no customer self-service. The Petitioner shall also strictly adhere to the operating procedures and copies of the variance and operating procedures are to be present on the MFDV during all periods of operation.
- On April 25, 2014 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(2)(a), Florida Administrative Code, Paragraph 61C-4.010(7), Florida Administrative Code, Paragraph 61C-4.010(6), Florida Administrative Code, and Section 6-402.11, 2009 FDA Food Code from Depot Kitchen at Portofino Insland Resort located in Pensacola Beach. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom on the same level be provided for use by customers and employees. They are requesting to utilize bathrooms located on a different level.

Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the public bathrooms located on the second floor of the Portofino Island Resort are maintained in a clean and sanitary manner and are provided with hot and cold running water under pressure, soap, approved hand drying devices, handwash sign and are available during all hours of operation. The Petitioner shall also ensure that directional signage is installed in the main restaurant area clearly stating the location of the bathrooms.

- A petition for a change in the rates of pilotage charged by the licensed state pilots and certified deputy pilots at the Port of Miami has been filed with the Pilotage Rate Review Committee, pursuant to Section 310.151, Florida Statutes and Chapter 61G14, Florida Administrative Code.
The last rate change (increase) granted the Port of Miami was April 1, 2002. The board intends to consider the following requested rate change (decrease) for the Port of Miami:
The petition requests the following changes:
Draft charge decreased, for passenger vessels only, from $17.433 per foot to $13.075 per foot.
Tonnage charge decreased, for passenger vessels only, from $0.0364 per GRT to $0.0273 per GRT.
All other charges currently in place at the Port of Miami would remain the same, with the exception that any fees based on draft and tonnage shall be subject to a 25% discount when applied to passenger vessels.
The Committee’s site visit to the Port of Miami will occur on Wednesday, July 30, 2014 at 2:00 pm at 2911 Port Boulevard, Miami, FL 33132.

- The Florida Department of Transportation (FDOT) District Five invites you to attend the Final Public Meeting regarding the SR A1A Multimodal Corridor Planning & Engineering Analysis. The purpose of the analysis is to evaluate the mobility and economic development potential of communities along the SR A1A Corridor from SR 404/Pineda Causeway to SR 528, through the Cities of Cocoa Beach, Cape Canaveral, and Brevard County, FL.
The analysis will consider multiple modes (walking, bicycling, automobile, public transit, etc.) and their connections so that each mode can accomplish its optimal role. The study considers existing and future land use contexts, travel needs/patterns, transportation infrastructure, etc.
The purpose of the Public Meeting is to obtain public feedback on project recommendations for potential corridor improvements and the schedule for implementation to promote safe, walkable transportation solutions along SR A1A.
The Public Meeting will be an informal open house where participants are welcome to attend at any time between 6:00 p.m. and 8:00 p.m. There will be an overview presentation at 6:30 p.m. Display maps illustrating the analysis corridor, the schedule, and other information will be available for public review and comment at the public meeting. Project representatives also will be present to discuss the analysis, receive public input, and answer questions.
