- That on May 13, 2013, the Department of Transportation entered an Order Granting Petition for Variance in response to the Petition for Variance filed by Jerry Pate Design, Inc., seeking a variance from the provisions of Rule 14-75.003(5)(m)(2), F.A.C. The Petitioner specifically requests a variance from the five-year post-registration experience qualification requirement for landscape architecture. The Petition was received by the Department on March 7, 2013. The Department published its notice of receipt of the Petition in the March 21, 2013, edition of the Florida Administrative Register. The Department granted the Petition because Jerry Pate Design, Inc.’s landscape architect’s records of education, pre-registration experience, and accomplishments meet or exceed the Department’s required level of expertise for design of roadway landscape projects.

- that on May 9, 2013, the Governing Board issued an Order Granting Variance under Section 120.542, Fla. Stat., (Order No. 2013-043-DAO-WU) to 951 Yamato Acquisition Company, LLC, in Palm Beach County. The Petition for Variance was received by the District on February 26, 2013. Notice of receipt of the Petition requesting the variance was published in the Florida Administrative Register, Vol. 39, No. 48, on March 11, 2013. No public comment was received. Specifically the Order grants a Variance from Subsection 40E-24.201(7), Florida Administrative Code (Fla. Admin. Code), which states that irrigation of existing landscape, shall be conducted on specific days. Generally, the Order sets forth the basis of the District's decision to grant the Variance, as follows: 1) the Petitioner has demonstrated that the use of the advanced technology irrigation system on its specified property is likely to achieve the purpose of the statutes underlying Subsection 40E-24.201(7), Fla. Admin. Code; 2) the Petitioner has demonstrated that it will experience substantial technological hardship if it is required to comply; 3) the District has reasonable assurance that the granting of this Variance will be consistent with statutory requirements.

- That on May 14, 2013, the Department of Health filed an Order disposing of a petition for variance from the requirements of subparagraph 64E-28.006(3)(b), F.A.C., which requires internet-based tattoo education courses to incorporate a means of identity verification and validation using technology that seeks verification through internet databases using information that is specific to the student’s identity and 64E-28.006(3)(c). F.A.C., which requires the automatic termination of this course when the student fails to answer an identity validation question during a 60 second response time or the student provides more than one incorrect answer. The petition filed by Jeff Godin, on behalf of ICE Training Institute, was filed with the Department on January 28, 2013, and noticed in the F.A.R. on February 8, 2013, in Vol.39, No. 27. The Department determined that the Petitioner was able to demonstrate that the underlying statute will have been achieved or has been achieved by other means and that application of the rules would violate the principals of fairness. Therefore, the petition for permanent variance is GRANTED.
