- that on June 5, 2017, a Notice of Intent to Deny Petition for Waiver and Variance was filed. The Petition for Waiver or Variance was filed by Thanh Kim Dau, O.D., on April 18, 2017, seeking a waiver or variance from Rule 64B13-4.001, F.A.C., regarding the requirement that all four (4) parts of the licensure examination must have been passed within the seven (7) year period immediately preceding application for licensure. Petitioner also sought a waiver of Rule 64B13-6.001(5), F.A.C., regarding the application fee for certification as a certified optometrist. The Notice was published in Volume 43, No. 77, of the Florida Administrative Register, on April 20, 2017. The Board, at its meeting held on May 19, 2017, voted to deny the Revised Petition for Variance or Waiver finding that the Petitioner did not demonstrate a substantial hardship; that application of the rule did not violate the principles of fairness; and that the purpose of the underlying statute was not met.

- On June 9, 2017 the Division issued an order. The Final Order was in response to a Petition for an emergency permanent Variance from Niceville Fire Department, filed May 10, 2017, and advertised on May 15, 2017, in Vol. 43, No.94, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 2.2.2.5, ASME A17.1b, 2009 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code that requires upgrading the elevators sump pump because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2017-079).

- The Florida Department of Transportation (FDOT), District One, is holding a public information meeting regarding improvements to US 41 from Salford Boulevard to Sumter Boulevard in North Port, Florida. The public meeting is from 5 p.m. to 7 p.m. on Tuesday, June 20, 2017 at the North Port Public Library Juliano Room, 13800 Tamiami Trail, North Port, Florida 34287. FDOT will hold this meeting to give interested persons the opportunity to talk one-on-one with staff and make comments about the project.
The project includes widening US 41 to a six-lane highway, removing old asphalt and resurfacing the roadway, improving drainage, constructing sidewalk, installing new highway lighting, and new signing and pavement markings. The $10.1 million project begins late June/early July and completion expected in spring 2019.

- The intent of these projects is to widen just over six miles of State Road (S.R.) 388 from two to four lanes with a twelve foot shared-use path on the south and construct drainage improvements. Approximately four miles of Segment 5, from S.R. 79 to Northwest Florida Beaches International Airport, unique features include a multi-lane roundabout at the entrance to Northwest Florida Beaches International Airport, building a four-lane bridge over Crooked Creek with a dedicated wildlife crossing under the bridge, and an improved signalized intersection at S.R. 79. Segment 5 is funded for right-of-way acquisition and construction. Bids for construction will be received spring 2018. Two miles of Segment 6, from Northwest Florida Beaches International Airport to east of Burnt Mill Creek, unique features include removal of existing causeway and building a four-lane bridge over Burnt Mill Creek with a dedicated wildlife crossing under the bridge. Segment 6 is not funded for right-of-way or construction in the current FDOT Five-Year Work Program.
Maps, drawings, and other information will be on display. FDOT representatives will be available to answer questions and receive comments concerning this project; there will be no formal presentation.

- Cumulus Funding, Inc; On March 16, 2017, the Office of Financial Regulation (Consumer Finance) received a Petition for Declaratory Statement from Cumulus Funding Inc. The petition sought a declaratory statement from the Office on whether the future income investment agreement constitutes a loan in Florida, whether the agreement is subject to usury limits, and whether the petitioner is exempt from licensure under the consumer finance act, Chapter 516, Florida Statutes.
The Petition filed by Cumulus Funding, Inc was denied. The information that was included with the Petition is insufficient for the Office to complete its analysis of Petitioner's business model. Petitioner did not include a copy of its advertising, web pages, or other relevant promotional materials; the prospectus documents Petitioner provides to its prospective investors; favorable or unfavorable rulings by other states on Petitioner's proposed business activities; or applications filed by Cumulus and Align Income Share Funding with the Securities and Exchange Commission, including any other relevant information that would allow the Office to complete its required analysis. Consequently, due to the absence of the above-mentioned information, the Office is unable to determine whether Petitioner requires licensure under Chapter 516, Florida Statutes, to conduct its proposed activities within the State of Florida.
