- The purpose of the proposed amendment is to update, clarify, and re-adopt the forms and their instructions incorporated by reference in Chapter 34-8, F.A.C., and to address changes required by law. All of the referenced forms and instructions are being updated to reflect that loans made by a filer to his or her political campaign need to be disclosed if the amount is greater than the reporting threshold. All of the referenced forms and instructions are being updated to reflect that bank accounts in which a filer has an ownership interest, or which are being held as tenants by the entirety or jointly with a right of survivorship, need to be disclosed if their amount is greater than the reporting threshold. Rules 34-8.002 and 34-8.202, F.A.C., are being amended to have the Form 6 and Form 1, and their correlating instructions, reference the 2020 calendar year. Rules 34-8.008 and 34-8.208, F.A.C., are being amended to have the Form 6F and Form 1F, and their correlating instructions, reference the 2021 calendar year. Rules 34-8.002 and 34-8.009, F.A.C., are being amended to add language to the Form 6 and Form 6X emphasizing that Part F only applies to those officers required to complete annual ethics training pursuant to Section 112.3142, F.S. Rules 34-8.202 and 34-8.209, F.A.C., are being amended to add language to Part G of the Form 1 and Form 1X, and their correlating instructions, indicating that appointed school superintendents and commissioners of community redevelopment agencies created under Part III, Chapter 163, F.S. must complete annual ethics training pursuant to Section 112.3142, F.S.

Petitioner seeks an emergency variance of the requirements of Rules 2.2.2.3 and 2.2.2.5, ASME A17.1, 2013 edition, as adopted by 61C-5.001, Florida Administrative Code that requires a sump pump be provided which poses a significant economic/financial hardship. Any interested person may file comments within 5 days of the publication of this notice with Division of Hotels and Restaurants, Bureau of Elevator Safety, 2601 Blair Stone Road, Tallahassee, Florida 32399-1013 (VW2020-088).

- that on June 11, 2020, an Order was filed on the Petition for Variance or Waiver. The Petition was filed by Mariza Giua, on March 6, 2020. Petitioner sought a variance or waiver of Rule 64B19-11.005(c), F.A.C., with regard to the requirement that a supervisor is either a licensed Florida psychologist in good standing with the Board, or a doctoral-level psychologist licensed in good standing in another state or United States territory or Canada providing supervision for licensure in that state or territory. However, where the psychology resident or post-doctoral fellow is on active duty with the armed services of the United States, or employed full time by the United States as a civilian psychology resident or post-doctoral fellow to provide services to the armed services or to a veterans administration facility, the supervisor may be a doctoral-level psychologist licensed in good standing in any state or territory, regardless of where the supervision is conducted.
The Notice of Petition for Variance or Waiver was published in Vol. 46, No. 49, on March 11, 2020, in the Florida Administrative Register. The Board, at its meeting held on April 24, 2020, voted to grant the Petition for Variance or Waiver finding that Petitioner demonstrated a substantial hardship; demonstrated that application of the rule would violate the principles of fairness; and demonstrated that the purpose of the underlying statute had been met.

Petitioner is seeking a variance or waiver of Rule 64B13-4.001(1)(d)2. and 3., F.A.C., which states in part that the licensure examination authorized in section 463.006(2), F.S., shall consist of four parts with one being the Florida Practical Examination. The Florida Practical Examination shall consist of three (3) tested skills and the Board requires passage of all three (3) skills on the same test attempt. The three (3) skills are Biomicroscopy, Binocular Indirect Ophthalmoscopy, Dilated Biomicroscopy and Non-Contact Fundus Lens Evaluation and are weighted equally. The passing score for each skill shall be seventy-five percent (75%) or better, and a passing score on each of the three (3) skills must be obtained on the same test attempt.

- On June 11, 2020 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 3-305.11(A)(2), 2017 FDA Food Code, Section 3-305.14, 2017 FDA Food Code, Section 6-202.15, 2017 FDA Food Code, Section 6-202.16, 2017 FDA Food Code, Paragraph 61C-4.010(1), Florida Administrative Code, and Paragraph 61C-4.010(6), Florida Administrative Code from EL LUNCH LATINO LLC located in Clearwater. The above referenced F.A.C. addresses the requirement for proper handling and dispensing of food. They are requesting to dispense bulk time/temperature control for safety foods from an open air mobile food dispensing vehicle.
The Petition for this variance was published in Vol 46/115. The Order for this Petition was signed and approved on June 22, 2020. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring that each pan within the steam table is properly covered with an individual lid; the steam table is enclosed within a cabinet with tight-fitting doors, and is protected by an air curtain installed and operated according to the manufacturer’s specifications that protects against flying vermin or other environmental contaminants; all steam table foods must be properly reheated for hot holding at approved commissaries and held hot at the proper minimum temperature per the parameters of the currently adopted FDA Food Code; and steam table food is to be dispensed by the operator with no customer self-service. The Petitioner shall also strictly adhere to the operating procedures and copies of the variance and operating procedures are to be present on the MFDV during all periods of operation.
