The Final Order was in response to a Petition for a Variance from UpTown Maitland, filed June 10, 2013, and advertised on June 12, 2013 in Vol. 39, No. 114, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 2.20.1, 2.18.5.1, 2.20.4, 2.20.5 and 2.20.9 ASME A17.1b, 2009 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code that requires steel ropes of a minimum diameter of 9.5 mm because the Petitioner has demonstrated that the intent of the rule will be met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2013-181).

- that on July 7, 2013, the Department of Environmental Protection has issued an order granting a variance to Miami-Dade Water and Sewer Department (Petitioner). The Petition was received by the Department on April, 16, 2013 and a Notice of receipt was published in the Florida Administrative Register on April 29, 2013. The petition requested a variance from Rule 62-604.400(2)(a), F.A.C., to be exempted from the requirement to install an on-site emergency generator at an existing Pump Station located at 2202 SW 26 St., Miami, FL. Petitioner instead requests to be able to use a portable generator. No public comment was received. The Order, file number 13-0935, granted the Petition based on a showing that Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner or would affect Petitioner differently than other similarly situated applicants and because Petitioner demonstrated that the purpose of the underlying statute will be or has been achieved by other means.
