The Notice of Petition for Waiver or Variance was published in Vol. 39, No. 93, of the May 13, 2013, Florida Administrative Register. Petitioner was seeking a variance or waiver of Rule 64B19-11.001(4)(b), Florida Administrative Code, which states that a passing score on the Florida laws and rules examination shall cease to be valid eighteen (18) months after the Board's letter to the applicant advising that the applicant has passed the Florida laws and rules examination.
The Board’s Order, filed on July 15, 2013, granted the petition finding that Petitioner has established that the purpose of the underlying statute, Section 490.005, Florida Statutes, would be met were the Petitioner to be granted a variance from the rule. Additionally, the Petitioner does demonstrate how the rule would create a substantial hardship and that it would violate the principles of fairness.

The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash and three-compartment sinks.

- Rule No: Section 61A-1.0101(3): Product Display Exceptions
On May 16, 2013, the Division received a Petition for Rule Waiver request in which the Petitioner, Treasury Wine Estates American Company request a temporary Rule Waiver of subsection 61A-1.0101(3), Florida Administrative Code. The Petitioner would like to lend Star Liquor a temporary “dummy” bottle, i.e. a replica of the original, to be displayed in Star Liquor’s until October 1, 2013, or the sale of the real Ampoule. The hand blown, specially boxed dummy Ampoule was limited to a very small number, causing it to exceed the limit of $300 for point of sale. The notice of receipt was published on the Florida Administrative Weekly website on 5/29/2013 Vol. 39/104.
On August 16, 2013, the Department of Business and Professional Regulation, Division of Alcoholic Beverages and Tobacco, filed an Order Granting in part, and denies in part Petitioner’s Petition for Variance for Wavier of Rule 61A-1.0101(3). On the contrary, Petitioner’s replica bottle would neither hold nor display the actual product to be sold, but would in fact replace it as the item of interest. Though the proposed arrangement is indeed unique, the replica bottle simply cannot qualify as a product displace item under Rule 61A-1.0101(1), F.A.C, thereby mooting any discussion of Rule 61A-1.0101(3), F.A.C.
