- NOTICE OF DISPOSITION OF VARIANCE
NOTICE IS HEREBY GIVEN that on August 29, 2013, the Florida Department of Environmental Protection granted a petition filed by Dixie Waste Services, LLC on July 12, 2013, seeking a variance under Section 120.542, Florida Statutes. The Petitioner applied for a renewal permit to construct and operate a materials recovery facility and a waste tire processing facility to be located at 322 NE 264th Street, Cross City, Dixie County, Florida. The Petitioner requested a variance from Rule 62-711.500(3)(a), Florida Administrative Code which requires submittal of proof of financial assurance for closing a waste tire site at a waste tire processing facility as part of the permit application. The petition demonstrated the Petitioner will suffer a substantial and unnecessary hardship if it is required to provide financial assurance before the facility is constructed. In its place, Petitioner will be required to provide financial assurance 60 days before receiving solid waste at the facility as is required for other solid waste processing facilities. Notice of receipt of the petition was published on the Florida Administrative Register on August 12, 2013. No comments were received. A copy of the Order Granting Variance is available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at the Department of Environmental Protection, Solid Waste Section, located at 2600 Blairstone Road, Tallahassee, Florida 32399.

Activities that require both a coastal construction permit and an environmental resource permit are authorized by a single joint coastal permit. The Department proposes to amend Chapter 62B-49 and add a new rule to implement the Laws of Florida 2012-65. The Department also proposes to clarify language in order to reduce confusion in the permitting process and reduce Requests for Additional Information (RAI’s). The Department proposes to add conditions and amend portions to expedite the permitting process.
