1. Notices of Development of Proposed Rules and Negotiated Rulemaking
- Department of Environmental Protection
- Departmental
- The purpose of the proposed rule development (OGC No. 13-1120) is to amend Rule 62-210.370, F.A.C., to conform with Section 403.0872, F.S., as amended by the Legislature in 2013, so that annual operation fees collected by the Department from major sources of air pollution (Title V sources) will be based on the actual amount of regulated air pollutants emitted, instead of being based on the amount of regulated air pollutants allowed to be emitted by permit. The Department also is repealing subsection 62-213.900(1), F.A.C., Major Air Pollution Source Annual Emissions Fee Form (DEP Form No. 62-213.900(1), Effective 10-12-08), and, therefore, is amending subsection 62-210.900(5), F.A.C., Annual Operating Report for Air Pollutant Emitting Facility, Form and Instructions (DEP Form No. 62-210.900(5), Effective 7-3-08), to address the major air pollution source annual emissions fees.
- The purpose of the proposed rule development (OGC No. 13-1121) is to amend subsection 62-213.205, F.A.C., to conform with Section 403.0872, F.S., as amended by the Legislature in 2013, so that annual operation fees collected by the Department from major sources of air pollution (Title V sources) will be based on the actual amount of regulated air pollutants emitted, instead of being based on the amount of regulated air pollutants allowed to be emitted by permit.
12-1180) is to amend the above-listed rules in Chapter 62-296, F.A.C., to correct erroneous cross references, remove or amend obsolete provisions, and clarify rule language, especially where needed as a result of the intended repeal of DEP Method 9 and to revise cross-references because of the intended repeal of Rule 62-297.401 and subsections of Rule 62-297.440, F.A.C., pursuant to Executive Order 11-01 (and subsequent Executive Orders 11-72 and 11-211).
- The purpose of the proposed rule development (OGC No. 12-0879) is to update Rule 62-297.310, F.A.C., to clarify the requirements and procedures for emissions tests.
- The purpose of the proposed rule development (OGC No. 12-1179) is to amend Rules 62-297.440 and 62-297.450, F.A.C. Subsections of Rule 62-297.440, F.A.C., will be repealed because they contain unnecessary adoptions by reference of test methods and procedures that are obsolete or elsewhere adopted by reference. The proposed amendments to Rule 62-297.450, F.A.C., reformat for the sake of clarification, but do not change, the requirements related to the procedures for determining the capture efficiency of a VOC capture system and incorporate language transferred from subsection 62-297.440(7), VOC Capture Efficiency Test Procedures, F.A.C. The proposed amendments also remove language that is redundant.

- This general public meeting is for interested stakeholders to discuss with the Department issues related to development of a nutrient total maximum daily load (TMDL) for Lake Tallavana in the Ochlockonee River basin. The meeting will provide an opportunity for the Department to present a general approach for developing the nutrient TMDL and receive feedback from local stakeholders. Furthermore, upon paragraph 62-302.531(2)(a), F.A.C., becoming effective, the Department intends for this nutrient TMDL to constitute a site specific numeric interpretation of the narrative nutrient criterion set forth in paragraph 62-302.530(47)(b), F.A.C., that will supersede the otherwise applicable numeric nutrient criteria in paragraph 62-302.531 for the particular surface water segment. Written comments on the TMDL approach should be directed to: Jan Mandrup-Poulsen, Environmental Administrator, Watershed Evaluation and TMDL Section, Florida Department of Environmental Protection, Mail Station #3555, 2600 Blair Stone Road, Tallahassee, Florida 32399-2400 or via email: jan.mandrup-poulsen@dep.state.fl.us.; September 19, 2013, 7:00 p.m.; First Baptist Church of Havana 116 E. 6th Ave., Havana, Florida, 32333 (meeting room located in the building behind the church)
