- The purpose of the proposed amendments to this rule is to incorporate changes enacted by the Legislature in Chapter 2017-105, Laws of Florida. The amendment includes adding two statute references to parallel s. 196.011(1)(b), F.S., which requires applicants to include the social security numbers on the application form, DR-501. The title of the form is included for identification. These changes allow certain totally and permanently disabled first responders to apply for exemption from taxation and explain how an applicant qualifies for the exemption.
- The purpose of amending this rule is to implement statutory changes enacted in the 2017 Legislative session and to update forms for statutory compliance. Amended forms include: Form DR-403EB, The (tax year) Ad Valorem Assessment Rolls Exemption Breakdown of ____County, Florida, to add new exemptions for the property appraiser to identify the number and value of exemptions for the tax roll certification; and Form DR-403V, The (tax year) Revised Recapitulation of the Ad Valorem Assessment Roll, Value Data, to add the new exemption types to the current list and update line references for calculations.
The amended forms also include Form DR-405, Tangible Personal Property Tax Return, to add line 24 to include renewable energy source devices; update the schedules on page 2 of the form to include new line 24, enacted in section 3 of Chapter 2017-118, L.O.F.; and include the new inventory definition enacted in Chapter 2017-36, L.O.F.
The amended forms further include two forms in the DR-489 series property appraisers use in the preliminary tax roll certification process to add exemptions to the current list on the DR-489EB, The (tax year) Ad Valorem Assessment Rolls Exemption Breakdown of ____ County, Florida; and to add to the exemptions listed on the Form DR-489V, The (tax year) Preliminary Recapitulation of the Ad Valorem Assessment Roll, Value Data, and correct line references for calculations.
Amendments to Form DR-501, Original Application for Homestead and Related Tax Exemptions, incorporate exemptions enacted in Chapter 2017-105, L.O.F., and other statutory changes as needed.
Amendments to Form DR-504, Ad Valorem Tax Exemption Application and Return, incorporate changes enacted in Chapter 2017-36, L.O.F., which amended s. 196.1978, F.S., adding an exemption for affordable housing property in a multi-family project and other statutory changes as needed.
The effect of these proposed amendments is that affected parties will have updated forms available that comply with current law.

- The purpose of the proposed new rules is to establish the requirements for carbon monoxide sensor devices as required under subsection 509.211(4), F.S., for public lodging establishments that contain a boiler regulated under Chapter 554, F.S. Rule 69A-70.005, F.A.C., will adopt the National Fire Protection Association (NFPA) code, NFPA-720-2015 edition, as the standard for carbon monoxide detectors in spaces or rooms of public lodging establishments that contain a boiler regulated under Chapter 554, F.S. Rule 69A-70.010, F.A.C., additionally requires labeling and compliance with Underwriters Laboratories, Standard 2017. An installation certification process is also imposed.

- a temporary waiver of Rule 11B-27.002(4), F.A.C., from Odelaysi Garcia Loydgren. Petitioner wishes to temporarily waive that portion of the Rule that states: (a) Within 4 years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment, and certification as an officer. (b) An individual who fails to comply with the requirements in paragraph (4)(a) of this rule section for the discipline in which the training was completed, within four years of the date of beginning such training, shall as a condition for obtaining employment comply with the following: 1. Successfully complete a Commission-approved Basic Recruit Training Program pursuant to Rule 11B-35.002, F.A.C., or qualify for an exemption from a Commission-approved Basic Recruit Training Program, pursuant to Section 943.131(2), F.S., to include demonstration of proficiency in the High-Liability Basic Recruit Training Courses pursuant to Rule 11B-35.0024, F.A.C.; and 2. Achieve a passing score on the State Officer Certification Examination. In justification of her petition for waiver, Petitioner asserts that she completed a commission-approved Basic Recruit Training Course in February of 2014 and that she subsequently passed the State Officer Certification Examination in March of 2014. Due to two pregnancies which resulted in cesarean section surgeries and breastfeeding demands, Petitioner did not seek employment as a law enforcement officer until January 14, 2017, when she applied for a position with the Hernando County Sheriff’s Office (HCSO). Petitioner asserts that she was still undergoing a background check with the HCSO when her timeframe for employment expired on May 14, 2017, and that the HCSO subsequently made her a conditional offer of employment, which the HCSO intends to honor. Petitioner alleges that, should the waiver not be granted, Petitioner will suffer a substantial hardship as she would be unable to serve as a certified law enforcement officer until she completes another basic recruit training academy and passes another State Officer Certification Examination at her own expense. Petitioner further asserts that she is part of a four-person, single income family and would not be able to afford childcare while she attends the basic recruit training program.
- a temporary emergency waiver of Rule 11B-35.002(2)(a), F.A.C., from Sergio Fernandes Martins. Petitioner wishes to temporarily waive that portion of the Rule that states: Within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination pursuant to rule 11B-30.0062, F.A.C., and gain employment and certification as an officer. In justification of his petition for waiver, Petitioner asserts that he began a commission-approved Basic Recruit Training Program in March of 2013 and passed the State Officer Certification Examination (“SOCE”) in August of 2013, but, because he was caring for an ill father and working to provide for his family, he was unable to obtain an offer of employment until May of 2017 when he submitted an application to the Holly Hill Police Department (“HHPD”). The HHPD made Petitioner a conditional offer of employment and completed his pre-employment screening but is now unable to activate Petitioner’s certification because, unfortunately, Petitioner’s four-year employment window expired in March of 2017. However, Petitioner asserts that the HHPD hopes to officially hire Petitioner should the emergency waiver be granted. Petitioner also alleges that, should the waiver not be granted, Petitioner will suffer a substantial hardship as he would have to undergo another Basic Recruit Training Program and pass another SOCE, resulting in both a financial burden and stress for his family. However, after a review of the Petition, FDLE determined that the Petition is not an emergency and that it shall be reviewed by FDLE on a non-emergency basis.

No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 3.11.3, A.S.M.E. A17.3, 1996 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code that requires fire fighter service because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2017-131).

- The Commission will present the Draft Species Action Plan for the Bald Eagle. The Species Action Plan replaces the 2008 Bald Eagle Management Plan, which was sunset by the Commission at the April 2017 meeting. - To conduct a TEFRA hearing concerning the potential future issuance of a tax-exempt bond by Florida Housing to provide additional financing for the acquisition, construction or rehabilitation of the following multifamily residential rental development in the aggregate face amount, not to exceed the amount listed below:
Centerra, a 104-unit multifamily residential rental development to be located at 18000 SW 107th Avenue, Miami, Miami-Dade County, FL. The owner and operator of the development is Centerra Associates, Ltd., 2100 Hollywood Blvd, Hollywood, FL 33020 or such successor in interest in which Centerra Associates, Ltd., or an affiliate thereof, is a managing member, general partner and/or controlling stockholder. The prospective manager of the proposed development is Cornerstone Residential Management, LLC, 2100 Hollywood Blvd., Hollywood, FL 33020. The tax-exempt bond amount is not to exceed $17,270,000.00.
All interested parties may present oral comments at the public TEFRA hearing or submit written comments regarding the potential bond issuance for the development being financed. Written comments should be received by Florida Housing by 5:00 PM (Tallahassee local time), September 21, 2017, and should be addressed to the attention of Brantley Henderson, Assistant Director of Multifamily Programs. Any persons desiring to present oral comments should appear at the hearing.
If requested in writing, a fact-finding hearing will be held in the county where the property is located. When possible, the local hearing will be held before the formal TEFRA hearing and comments received at the local hearing will be placed on record at the TEFRA hearing.
