1A-36. Florida Main Street Program |
1(1) For the purpose of reviewing Applications and making recommendations on such Applications, there is created annually the ad hoc Florida Main Street Advisory Committee. The Advisory Committee shall review and rank all Eligible Applications and shall recommend Applicants to the Secretary for designation as Local Programs based on the criteria in Rule 541A-36.008, 55F.A.C.
56(2) The Committee shall consist of up to eight members, representing the following public and private sector agencies and organizations:
76(a) Division of Historical Resources, Florida Department of State;
85(b) National Main Street Center of the National Trust for Historic Preservation;
97(c) Florida Department of Community Affairs;
103(d) Florida Redevelopment Association;
107(e) Florida League of Cities;
112(f) 1000 Friends of Florida;
117(g) Florida Trust for Historic Preservation; and
124(h) The Manager of an Active Local Program.
132(3) Annually, the Director shall request the head of each agency and organization listed in paragraphs (2)(b) through (g) above to appoint a representative to serve on the Advisory Committee. The Director shall annually appoint a member from the Division staff and a Manager from an Active Local Program to serve on the Advisory Committee.
187(4) With the exception of the Division representative, members of the Advisory Committee shall receive no compensation for their services or reimbursement from the Department for expenses incurred in the performance of said services.
221(5) As its first order of business, the Advisory Committee shall elect a chairperson from its membership.
238(6) Staff support for the Advisory Committee shall be provided by the Division and shall include, but not be limited to:
259(a) Providing notice of Advisory Committee meetings;
266(b) Preparing and distributing an agenda of the business to be transacted at each meeting of the Advisory Committee;
285(c) Evaluating Applications for completeness and eligibility;
292(d) Distributing eligible Applications and related materials to Advisory Committee members for review;
305(e) Recording Advisory Committee meetings;
310(f) Preparing and distributing a written report of the actions of the Advisory Committee;
324(g) Maintaining all records of the Advisory Committee;
332(h) Responding to public requests for information on the Advisory Committee and its activities; and
347(i) Participating in all Advisory Committee meetings to answer questions and provide such information as the Advisory Committee members may require.
368(7) The Advisory Committee shall be convened annually at a place, date and time designated by the Division. Advisory Committee members shall be provided with notice of a scheduled meeting and an agenda at least 30 days in advance of such meeting.
410(8) A copy of the agenda of any meeting of the Advisory Committee may be obtained by writing to the Bureau of Historic Preservation or by appearing in person at the offices of the Bureau of Historic Preservation at the address set forth in subsection 4551A-36.003(2), 456F.A.C.
457(9) Prior to each Advisory Committee meeting, members shall be provided with guidelines for application review. These guidelines shall include:
477(a) A description of the Florida Main Street Program.
486(b) An explanation of the Main Street Approach.
494(c) An explanation of the eligibility criteria, and other factors to be considered in evaluating and ranking the Applications.
513(d) Indication of the maximum number of communities that may be designated for the year.
528(10) A public notice of each Advisory Committee meeting shall be published in the Florida Administrative Register at least seven days prior to the date of the meeting. The notice shall provide:
560(a) The date, time and place of the meeting.
569(b) A brief description of the purpose of the meeting.
579(c) An address where interested persons may write to obtain a copy of the agenda.
594(11) For purposes of transacting business, a simple majority of the membership of the Advisory Committee shall constitute a quorum. All action taken shall be by a majority vote of the members present.
627(12) A written report of the actions of the Advisory Committee shall be prepared by the Division within 30 days of each Advisory Committee meeting. Advisory Committee members shall be provided with a copy of the written report, and shall notify the Director of any discrepancies within 30 days of receipt.
678(13) All members of the Advisory Committee shall comply with all laws governing conflicts of interest, including Chapter 112, Part III, F.S.
700(14) Any communication on a matter relevant to the duties or activities of the Advisory Committee may be directed to the Division at the address set forth in subsection 7291A-36.003(2), 730F.A.C.
