25-17.270. Changes in Environmental and Governmental Regulations

Effective on Monday, March 12, 2007

1All contracts for the purchase of capacity and energy from a renewable generating facility shall include a provision to reopen the contract, at the election of either party, limited to changes affecting the utility’s full avoided costs of the unit on which the contract is based as a result of new environmental and other regulatory requirements enacted during the term of the contract.
