40C-41.043. Application of Chapter

  • 1(1) All projects located within the Upper St. Johns River Hydrologic Basin, the Oklawaha River Hydrologic Basin, the Wekiva River Hydrologic Basin, the Wekiva Recharge Protection Basin, the Econlockhatchee River Hydrologic Basin, the Tomoka River Hydrologic Basin, the Spruce Creek Hydrologic Basin, the Sensitive Karst Areas Basin, 48or the Lake Apopka Hydrologic Basin, requiring permits pursuant to paragraphs 5962-330.020(2)(a), 60(b), (c), (d), (e), (f), (g), (h) or (j) or section 1.2.2, “Environmental Resource Permit Applicant’s Handbook Volume II: For Use Within the Geographic Limits of the St. Johns River Water Management District” as incorporated by reference in paragraph 9940C-4.091(1)(a), 100F.A.C., shall be constructed, operated, maintained, altered, abandoned and removed in accordance with the standards and criteria specified in rule 12040C-41.063, 121and rules 12362-330.301 124and 12562-330.302, 126F.A.C., unless specifically exempted in rule 13240C-41.051, 133F.A.C., or otherwise provided in subsection 13940C-41.043(3) 140or 14140C-41.043(4), 142F.A.C. The most restrictive criteria will be applicable unless the applicant provides reasonable assurance that the purposes and intent of this chapter and chapter 62-330, F.A.C., will be fulfilled using alternate criteria.

    174(2) Stormwater management systems requiring permits pursuant to rule 18362-330.020, 184F.A.C., that will be located within the Lake Apopka Hydrologic Basin or will discharge water to Lake Apopka or its tributaries, shall be constructed, operated, maintained, altered, abandoned and removed in accordance with the standards and criteria specified in rules 22462-330.301 225and 22662-330.302, 227F.A.C. and subsection 23040C-41.063(8), 231F.A.C.

    232(3) Agricultural surface water management systems requiring permits pursuant to Rule 24340C-44.041, 244F.A.C., that will be located within the Lake Apopka Hydrologic Basin or will discharge water to Lake Apopka or its tributaries, shall be constructed, operated, maintained, altered, abandoned and removed in accordance with the standards and criteria specified in Rule 28440C-44.301, 285F.A.C., and subsection 28840C-41.063(8), 289F.A.C.

    290(4) Agricultural surface water management systems requiring permits pursuant to Rule 30140C-44.041, 302F.A.C., that will be located within the Wekiva Recharge Protection Basin, shall be constructed, operated, maintained, altered, abandoned and removed in accordance with the standards and criteria specified in rule 33240C-44.301, 333F.A.C. and paragraph 33640C-41.063(3)(a), 337F.A.C.
