40E-41. Surface Water Management Basin And Related Criteria |
1(1) All projects located within the Kissimmee River Basin requiring permits pursuant to Chapter 62-330, F.A.C., shall be constructed, altered, operated, maintained and abandoned in accordance with the criteria specified in Rules 3362-330.301, 3462-330.302 35and 3640E-41.163, 37F.A.C., unless specifically exempted by Section 43373.406, F.S..
45(2) The criteria set forth in Rule 5240E-41.163, 53F.A.C., shall be considered more restrictive than that set forth in Rule 6562-330.301 66and 6762-330.302, 68F.A.C. The most restrictive criteria will be applicable unless the applicant can demonstrate through accepted scientific and technical methodology that the purpose and intent of this part will be fulfilled by the use of alternate criteria.
104(3) All projects located within the Kissimmee River Basin requiring permits pursuant to Rules 11840E-6.041 119and 12040E-6.331, 121F.A.C., shall comply with the criteria set forth in Rules 13140E-6.121, 13240E-6.221 133and 13440E-41.165, 135F.A.C.
136(4) The criteria set forth in Rule 14340E-41.165, 144F.A.C., shall be considered more restrictive than that set forth in Rule 15640E-6.121 157and 15840E-6.221, 159F.A.C. The most restrictive criteria will be applicable.
