53ER14. Emergency Rule For Year 2014 |
1(1) 2Beginning January 7, 2014, through March 31, 2014, the Florida Lottery will conduct the 16Forever Fabulous 18Second Chance Promotion. 21Players can enter their non-winning FLAMINGO® Florida Lottery Scratch-Off tickets into a second chance drawing on the Florida Lottery website for a chance to win a VIP trip for two to the Flamingo® Las Vegas or a Flamingo® merchandise prize package. Winning FLAMINGO® tickets cannot be used for entry into the Forever Fabulous 74Second Chance Promotion.
77(2) 78A total of three second chance drawings will be held between February 5, 2014, and April 2, 2014, from entries submitted before midnight ET on the last day of the entry period for each drawing. Entries will be good for one drawing only. The drawing schedule is:

168(3) 169In each of the three 174second chance drawings, 177ten grand prize winners will win a VIP trip for two to the Flamingo® Las Vegas, and one hundred prize winners will win a Flamingo® merchandise prize package. A grand total of three hundred and thirty prizes will be awarded in the second chance drawings.
222(4) 223To enter a non-winning FLAMINGO® Scratch-Off ticket into a second chance drawing, visit the Florida Lottery’s website at 241www.flalottery.com, 242click on the Forever Fabulous 247Second Chance Promotion banner, and follow the “Ticket Entry” directions. Players will be prompted to log in or register. Scratch off the latex covering to reveal the 24-digit ticket number (4-digit game number and 20-digit ticket number) located below the play instructions on the front of a Scratch-Off ticket and enter the entire 24-digit ticket number in the designated area.
307(5) Players may enter as many times as they wish during the promotion period. However, each valid ticket number may only be used one time, for entry 334in335t336o one second chance drawing. Tickets should not be mailed to the Lottery unless players are contacted by the Florida Lottery and requested to do so. Non-winning tickets received in the mail by the Florida Lottery will not be entered into a drawing and will not be returned. The odds of winning are dependent upon the number of entries submitted. All entries are subject to validation by the Florida Lottery and may be disqualified if eligibility requirements are not met.
416(6) Drawings. 418In 419each of the three drawings, the first through tenth valid 429entries drawn will win a grand prize. The eleventh through the one hundred and tenth valid entries drawn will each win a second prize. The eleventh through fifteenth valid entries drawn will serve as alternate winners in the order drawn for the grand prize in the event the grand prize cannot be awarded. Alternate winners will not be selected for second prizes.
491(7) Notification.
493(a) The prize winners in each second chance drawing will be posted on flalottery.com after the drawing.
510(b) 511The F513lo514r515ida Lottery will attempt to notify each grand prize winner 525no later than twenty-four hours after the winners are posted on the Florida Lottery’s website. Notification will be made by telephone, U.S. mail or email using the contact information provided in the winner’s registration data. If the Florida Lottery is unable to have personal contact with a grand prize winner within three weeks of the date of the drawing, the winner will forfeit his or her right to claim the prize and the Florida Lottery will award the prize to the first alternate winner as set forth in subsection (6) above. 616If the Florida Lottery is unable to have personal contact with the first alternate winner within one week of the date of award of the prize, the alternate winner will forfeit his or her right to claim the grand prize and the Florida Lottery will award the prize to a second alternate winner. This process will continue until an alternate is contacted or the Florida Lottery has exhausted the list of available alternates. If the Lottery is unable to contact an alternate, the prize will not be awarded.
704(c) 705The Florida Lottery will attempt to notify each second prize winner by telephone, U.S. mail, or email using the contact information provided in the winner’s registration data no later than seven business days after the winners are posted on the Florida Lottery’s website in order to confirm the winner’s mailing address. If the Florida Lottery is unable to contact a second prize winner within thirty days of the date of the drawing, the winner will forfeit his or her right to claim the prize and the prize will not be awarded.
796(d) A grand prize alternate winner who has not been shipped a second prize at the time of notification that he or she is the alternate winner of a grand prize will be awarded only the grand prize. A grand prize alternate winner who has been shipped a second prize at the time of notification may retain his or her second prize in addition to the grand prize; however, the grand prize in this scenario will not contain a Flamingo® merchandise prize package.
879(8) How to Claim a Prize.
885(a) To claim a grand prize in a second chance drawing, the winner must submit to the Florida Lottery the original valid non-winning FLAMINGO® 909Scratch-Off 910ticket bearing the entry number selected in the drawing. Without such ticket, the winner will forfeit his or her right to claim a prize. Winners must submit the valid entry ticket along with a completed Winner Claim Form DOL 173-2, revised 02/11, or Spanish Winner Claim Form DOL 173-2S, revised 02/11, a copy of acceptable identification and a notarized Florida Lottery Release and Authorization Form DOL-474, revised 8/13 or Spanish Florida Lottery Release and Authorization Form DOL-474S, revised 8/13. 989Forms DOL 173-2, DOL 173-2S, DOL-474 and DOL-474S are hereby incorporated by reference 1002and may be obtained at any Lottery office, from the Florida Lottery’s website at 1016www.flalottery.com, 1017or by writing to: Florida Lottery, Customer Service, 250 Marriott Drive, Tallahassee, Florida 32399-4016. The required forms must be received by the Florida Lottery no later than two weeks after the Florida Lottery has made personal contact with the winner. If the Florida Lottery has not received the required forms from a grand prize prize winner by the fourteenth day after notification, the winner will forfeit his or her right to claim the prize and the Florida Lottery will award the prize to an alternate winner as described in subsections (6) and (7) above.
1111(b) Second prize winners are not required to submit the original non-winning FLAMINGO® Scratch-Off ticket or the documentation listed in paragraph (8)(a) above in order to claim the prize. However, second prize winners who become alternate winners of a grand prize will be required to submit the original non-winning FLAMINGO® Scratch-Off ticket and the required documentation in order to claim the higher prize. Therefore, grand prize alternate winners should retain the original non-winning FLAMINGO® Scratch-Off ticket until notified by the Florida Lottery that the grand prizes have been fulfilled.
1200(9) Grand Prizes.
1203(a) Upon 1205the Florida Lottery’s receipt of a grand prize winner’s required documentation, the Lottery will award a prize of a 1224VIP Las Vegas Trip Package. The trip package shall include the following:
12361. Round trip coach air transportation to and from Las Vegas, Nevada from any U.S. commercial service airport for winner and guest;
12582. Four day/three nights’ deluxe hotel accommodations at the Flamingo® Las Vegas (suite accommodations, subject to availability for the dates selected) (double occupancy room, room tax and resort fees only);
12883. $1,000 food and beverage credit redeemable at any Flamingo® Las Vegas food or beverage location (credit provided upon check-in and expires upon checkout);
13134. Round trip ground transfer between the Las Vegas airport and the Flamingo® Las Vegas;
13285. Two VIP tickets to the Donny & Marie show with a meet and greet at the Flamingo® Las Vegas (or two VIP tickets to a comparable show of the winner’s choice at any of the Caesars Entertainment properties in Las Vegas in the event the Donny & Marie show is not running during the dates selected by the winner);
13886. $250 spending money payable as a Visa or Mastercard debit card; and
14017. Flamingo® merchandise prize package which includes:

1452The estimated retail value of the grand prize is $5,800. The actual value of the grand prize is dependent upon the location of the winner. The Florida Lottery will pay applicable federal income tax withholding on the actual value of the prize. The reportable taxable value of the prize includes the actual value of the prize and the value of the federal income tax withholding paid by the Lottery.
1522(b) The trip package does not include: mileage, insurance, gratuities, meals, parking fees, departure fees, excess baggage fees, alcoholic beverages, any items not expressly specified and personal expenses such as telephone calls, valet service, laundry and the like, as well as revision or cancellation fees which may be charged by the airline, the hotel or other suppliers.
1579(c) Grand prize winners shall have one year from the date of claiming the grand prize to begin their travel. Blackout dates are as follows: New Year’s Eve, Superbowl weekend, CES Trade Show week [January 7-10, 2014 (2015 dates TBD)], NASCAR [March 7-9, 2014 (2015 dates TBD)], 41627th 1628of July, Memorial Day, Labor Day, Global Gaming Expo [September 30- October 2, 2014 (2015 dates TBD)] and the first weekend in November. A thirty day minimum advance reservation is required.
1659(d) Unless otherwise specified by the Lottery, if a grand prize winner fails to arrive for the scheduled flight or fails to check into the hotel, the grand prize winner shall forfeit the flight and/or hotel portion of the trip package and the entire value of the prize shall remain taxable income to the grand prize winner.
1716(e) All winners, designee(s) or guests must have a valid credit card or shall be required to post cash deposits for incidentals in order to check into the hotel, unless other arrangements are made directly with the hotel. At least one member of the party must be at least eighteen years old in order to check into the hotel.
1775(f) A grand prize winner may transfer the travel portion of the trip package to another person with express written consent of the Lottery. In the event of a transfer, the grand prize winner shall receive the $250 Visa or MasterCard Debit card and the Flamingo® merchandize prize package; however, the entire value of the grand prize shall remain taxable income to the grand prize winner. If the trip package is transferred after airline reservations have been made and a charge is imposed for transferring the reservations, the grand prize winner will be responsible for paying the additional charge imposed.
1875(10) Grand Prize Fulfillment. The Florida Lottery will provide a grand prize winner a certificate describing the prize and the fulfillment process. The Florida Lottery will provide the grand prize winner’s information to the fulfillment company. The fulfillment company will contact the grand prize winner within ten business days from the date of receipt of the winner’s information to begin making travel arrangements and shall mail the grand prize winner the debit card approximately two weeks prior to the scheduled trip departure date. Also upon contact with the grand prize winner, the merchandise prize package portion of the grand prize shall be fulfilled in accordance with subsection (11) below.
1984(11) Second Prize Fulfillment. Upon the Florida Lottery’s confirmation of a second prize winner’s mailing address, the Lottery will award a prize of a Flamingo® merchandise prize package consisting of the items set forth in subparagraph (9)(a)7. above. Prior to notifying 2025the fulfillment company of the winner’s information, the Florida Lottery shall obtain the winner’s preferred shirt size (2043if for any reason the Florida Lottery is unable to obtain the winner’s preferred shirt size, the winner will be sent a polo shirt in size Large). 2070The fulfillment 2072company will ship the contents of the merchandise prize package in two shipments. The first shipment will contain all the merchandise prize package elements except the polo shirt, and will be shipped within approximately ten days of the fulfillment company’s receipt of the winner’s information. The second shipment will contain the polo shirt and will be shipped within approximately six weeks of the fulfillment company’s receipt of the winner’s information. (Retail value $410)
2145(12) All prizes are subject to the provisions of Chapter 24, F2157.2158S2159., 2160and rules promulgated thereunder.
2164Prizes shall be paid in accordance with the rule of the Florida Lottery governing payment of prizes. A copy of the current prize payment rule can be obtained from the Florida Lottery, Office of the General Counsel, 250 Marriott Drive, Tallahassee, Florida 32399-4011.
2207(13) Except as specifically mentioned herein, all federal, state and/or local taxes or other fees on the prizes won in the Forever Fabulous 2230Second Chance Promotion will be the responsibility of the winner.
2240(14) No cash option is available in lieu of Forever Fabulous Second Chance Promotion prizes.
2255(15) Players must be at least 18 years of age. Persons prohibited by Section 226924.116, 2270F2271.2272S2273., 2274from purchasing a Florida Lottery ticket are not eligible to play.
2285(16) The right to claim a prize cannot be assigned to another person or entity.
2300(17) By entering the Forever Fabulous 2306Second Chance Promotion, a player gives his or her permission for the Florida Lottery to provide the player’s address and telephone number to the prize fulfillment company for prize fulfillment purposes.
2337(18) By entering the Forever Fabulous Second Chance Promotion, a player gives his or her permission for the Florida Lottery to photograph and/or videotape and record the prizewinner with or without prior notification and to use the name, photograph, videotape, and/or recording of the prizewinner for advertising or publicity purposes without additional compensation.
2390(19) The Forever Fabulous second chance drawings shall be public, held in Tallahassee, Florida, and witnessed by an accountant employed by an independent certified public accounting firm. The results of each drawing will be available after the drawing on the Florida Lottery’s website at flalottery.com.
