60L-39.004. Eligibility Criteria for Participation by Charitable Organizations (Repealed)

  • 1(1) For purposes of ensuring compliance with the eligibility criteria of Sections 13110.181(1)(c)-14(e), F.S., charitable organizations are subject to the following:

    23(a) Charitable organizations with fundraising and administrative expenses in excess of 25% shall provide justification to demonstrate extraordinary circumstances beyond the charitable organization’s control 47such as unexpected destruction of facilities due to severe weather, fire, or similar events. 61Such circumstances do not include reduced fundraising or investment revenues, or increased administrative or fundraising expenses that have arisen as a consequence of the organization’s operational decisions88.

    89(b) Religious charitable organizations which provide services described in Section 99110.181, F.S., 101may not be excluded because of religious viewpoint.

    109(c) Organizations which comply with all applicable state and federal nondiscrimination laws shall be deemed in compliance with Section 128110.181(1)(e)3., F.S.

    130(d) 131Organizations which are required to register pursuant to the Solicitation of Contributions Act, Chapter 496, F.S., shall have a registration number that is valid on March 1, of the application year. 

    162(e) Organizations which are duly registered under section 501(c)(3), Internal Revenue Code, shall be deemed in compliance with Section 181110.181(1)(e)5., F.S. 

    183(2) The Department shall disqualify any approved charitable organization for:

    193(a) Failing to maintain eligibility for participation in the campaign, if such failure occurs prior to publication of the campaign brochure; or,

    215(b) Filing an application to participate in the FSECC that contains false or misleading information that is material to the applicant’s eligibility.

    237(3) Charitable organizations shall 241certify that they are not prohibited by federal law, Executive orders, and regulations from participating in the campaign.
