62-17. Electrical Power Plant Siting |
1(1) The certification hearing, if held, and any Recommended Order issued thereupon shall address the extent to which the project comports with the provisions, as applicable, of Section 29403.509(3), F.S.
31(2) In the certification hearing, the applicant, the Department and any other participating parties are encouraged to design their presentations to inform the public of the details of the proposed power plant, but the question of compliance with this paragraph shall not be the basis for review.
78(3) Each party shall make available for public inspection at least five days prior to the certification hearing, if held, at a place specified in the public notice any written direct testimony which it intends to submit at the hearing.
118(4) 119Delays in the issuance of a related federally delegated or approved draft permit are good cause for the continuance of the certification hearing, or any other time frame.
147(5) In regard to the properties and works of any agency which is a party to the certification hearing, any stipulation filed pursuant to Section 172403.508(6)(a), F.S., 174must include a stipulation regarding issues relating to the use, the connection thereto, or the crossing thereof, for the electrical power plant and directly associated facilities. Any agency stipulating to the use, connection to, or crossing of its property must agree to execute, within 30 days after the entry of certification, the necessary license or easement for such use, connection, or crossing, subject only to the conditions set forth in such certification.
