62-730. Hazardous Waste |
1(1) No permit under this chapter shall be required for the following:
13(a) An ocean disposal barge or vessel, if the owner or operator:
251. Has and complies with a Federal permit for ocean dumping issued under 3840 CFR Part 220, 42and
432. Complies with 4640 CFR 264.11, 49264.71, 264.72, 264.73(a) and (b)(1), 264.75, and 264.76 [as adopted in subsection 6162-730.180(1), 62F.A.C.].
63(b) A Publicly Owned Treatment Works (POTW), if the owner or operator:
751. Has and complies with a National Pollutant Discharge Elimination System (NPDES) permit, if required, and an applicable State domestic waste permit issued by the Department,
1012. Complies with 10440 CFR 264.11, 107264.71, 264.72, 264.73(a) and (b)(1), 264.75, and 264.76 [as adopted in subsection 11962-730.180(1), 120F.A.C.],
1213. Accepts only waste which meets all Federal, State, and local pretreatment requirements which would be applicable to the waste if it were being discharged into the POTW through a sewer, pipe, or similar conveyance, and
1574. For permits issued after November 8, 1984, complies with 16740 CFR 264.101 170[as adopted in subsection 17462-730.180(1), 175F.A.C.].
176(c) An injection well, if the owner or operator:
1851. Has and complies with a State underground injection permit issued by a federally approved State Underground Injection Control program,
2052. Complies with 20840 CFR 264.11, 211264.16, 264.71, 264.72, 264.73(a),(b)(1), and (b)(2), 264.75, and 264.76 [as adopted in subsection 22562-730.180(1), 226F.A.C.], and
2283. For permits issued after November 8, 1984, complies with 23840 CFR 264.101 241[as adopted in subsection 24562-730.180(1), 246F.A.C.].
247(2) Notwithstanding any other provision in Chapter 62-730, F.A.C., a facility which has been issued a permit under this chapter shall not be required to obtain a Department solid waste permit for the activities addressed in the hazardous waste permit.
287(3) The following persons shall not be required to obtain a hazardous waste TOP, operation, construction, or closure permit:
306(a) Generators of hazardous waste and hazardous waste facilities exempted or excluded from the hazardous waste permit program under other applicable provisions of federal or state law, rules or regulations, so long as all conditions of the exemption or exclusion are met.
348(b) Generators of waste or facilities managing such wastes if those wastes are specifically excluded from the hazardous waste program under other applicable provisions of federal or state law, rules or regulations, so long as all conditions of the exclusion are met.
