64B13-15. Discipline |
1(1) Pursuant to sections 5120.695 6and 7456.073(3), F.S., 9a notice of noncompliance will be issued as the first enforcement action taken against a licensee for a minor violation of a rule or a statutory provision which does not endanger the public health, safety and welfare and does not demonstrate a serious inability to practice the profession of optometry.
59(2) The Board designates the following as minor violations for which a notice of noncompliance may be issued.
77(a) Paragraph 7964B13-15.005(1)(a), 80F.A.C., and section 83456.062, F.S., 85entitled “Advertisement by health care provider of free or discounted services; required statement.”
98(b) Paragraph 10064B13-15.005(1)(c), 101F.A.C., and section 104456.011, F.S., 106“Exhibition of license.”
109(c) Subsection 111463.0135(8), F.S., 113relating to the maintenance of physician, clinic, or hospital referral list.
124(d) Subsection 126893.055(8), F.S., 128relating to a first-time failure to consult the Prescription Drug Monitoring Program Controlled Substance Dispensing Information Electronic System.
146(3) The issuance of a notice of noncompliance does not constitute professional discipline.
