69B-241. Penalty Guidelines For Bail Bond Agents |
1If the licensee is found to have willfully violated any of the following Department rules, the following stated penalties shall apply to licensees who have willfully violated the following sections of the Florida Administrative Code:
36(1) Rule 3869B-221.003, 39F.A.C. – Suspension for not more than 3 months or until compliant for the first violation; suspension for not less than 3 months but not more than 12 months for every violation subsequent to the first.
75(2) Subsection 7769B-221.051(1), 78F.A.C. – Suspension of all agency operations until the agency achieves compliance, which shall include suspension of licenses of all owners and operators.
101(3) Subsection 10369B-221.051(2), 104F.A.C. – Suspension for not more than 6 months for the first violation; suspension for not more than 12 months for every violation subsequent to the first.
131(4) Paragraph 13369B-221.051(4)(a), 134F.A.C. – Suspension for not more than 6 months for the first violation; suspension for not less than 6 months up to 12 months for every violation subsequent to the first.
165(5) Paragraph 16769B-221.051(4)(b), 168F.A.C. – Administrative fine of up to two times the amount of hours worked times the amount of minimum salary or wages as required by Florida minimum wage Act, pursuant to section 200448.110, F.S.
202(6) Paragraph 20469B-221.051(4)(c), 205F.A.C. – Except for violations for which the penalty is stated in the Florida Statutes, the penalty shall be suspension for not more than 6 months and an administrative fine of $500 per report.
239(7) Subsection 24169B-221.055(1), 242F.A.C. – Administrative fine of $1,000.
249(8) Subsection 25169B-221.055(2), 252F.A.C. – Suspension for 6 months and an administrative fine of $250 per file.
266(9) Rule 26869B-221.060, 269F.A.C. – Suspension for not more than 6 months for the first violation; suspension for not less than 3 months but not more than 12 months for every violation subsequent to the first.
302(10) Rule 30469B-221.065, 305F.A.C. – Suspension for not more than 3 months for the first violation; suspension for not more than 12 months for every violation subsequent to the first.
332(11) Rule 33469B-221.085, 335F.A.C. – Suspension for not more than 3 months for the first violation; suspension for not more than 12 months for every violation subsequent to the first.
362(12) Rule 36469B-221.095, 365F.A.C. – Suspension for 3 months for the first violation; suspension for not less than 12 months up to 24 months for every violation subsequent to the first.
393(13) Rule 39569B-221.100, 396F.A.C. – Suspension for not more than 3 months for the first violation; suspension for not more than 12 months for every violation subsequent to the first.
423(14) Rule 42569B-221.105, 426F.A.C. – Suspension for not more than 6 months for the first violation; suspension for not more than 12 months for every violation subsequent to the first.
453(15) Rule 45569B-221.110, 456F.A.C. – Suspension for not more than 6 months for the first violation; suspension for not more than 12 months for every violation subsequent to the first.
483(16) Rule 48569B-221.115, 486F.A.C. – Suspension for not more than 6 months for the first violation; suspension for not more than 12 months for every violation subsequent to the first.
513(17) Rule 51569B-221.120, 516F.A.C. – Suspension for not more than 6 months for the first violation; suspension for not more than 12 months for every violation subsequent to the first.
543(18) Rule 54569B-221.130, 546F.A.C. – Suspension for not more than 3 months for the first violation; suspension for not more than 12 months for every violation subsequent to the first.
573(19) Rule 57569B-221.135, 576F.A.C. – Suspension for not more than 12 months for the first violation; suspension for not less than 12 months for every violation subsequent to the first.
603(20) Rule 60569B-221.140, 606F.A.C. – Suspension for not more than 3 months for the first violation; suspension for not more than 12 months for every violation subsequent to the first.
633(21) Rule 63569B-221.145, 636F.A.C. – Suspension for 3 months for the first violation; suspension for 24 months up to revocation for every violation subsequent to the first.
