69O-157. Long-Term Care Insurance |
1The term “waiting period” or “probationary period” as used in a long-term care policy shall be that period of time which follows the date a person is initially insured under the policy before the coverage or coverages of the policy shall become effective as to such person. The waiting period shall be specified in the policy and:
58(1) A waiting period shall not be used with respect to any loss resulting from accidental injuries as defined in the policy;
80(2) A waiting period shall not exceed one year; and
90(3) There shall be no policy provision to establish a new waiting period in the event existing coverage is converted to or replaced by new or other forms within the same company, except with respect to an increase in benefits voluntarily selected by the insured individual or group policyholder.
