69O-171.010. Insurer Assignment Agreement Reporting – Calendar Year Experience

  • 1(1) Any insurer authorized to transact residential property or commercial property insurance shall report, for each such line of insurance, the information required by Section 26627.7152(12), F.S., 28or required by rule, on and pursuant to the instructions in Form OIR-B1-2221, “Assignment of Benefits (AOB) Experience Reporting Form,” effective 3/20, hereby incorporated by reference and available at 58http://www.flrules.org/Gateway/reference.asp?No=Ref-1241860.

    61(2) For purposes of this rule, “residential property and commercial property insurance” includes the following lines of business:

    79(a) Allied Lines, excluding Time Element;

    85(b) Commercial Multiple Peril;

    89(c) Earthquake;

    91(d) Farmowners Multiple Peril;

    95(e) Glass;

    97(f) Homeowners Multiple Peril;

    101(g) Industrial Extended Coverage;

    105(h) Industrial Fire;

    108(i) Mobile Homeowners Multiple Peril;

    113(j) Mobile Homeowners Physical Damage Only; and

    120(k) Property (Fire).

    123(3) The following data elements are to be included in the data reporting form:

    137(a) NAIC Company Code

    141(b) Company Name

    144(c) Unique Claim ID

    148(d) Type of Policy

    152(e) County of Loss

    156(f) Building Replacement Cost

    160(g) Peril

    162(h) Date of Loss/Incident

    166(i) Date Reported to Insurer

    171(j) Date of First Claim Payment

    177(k) Date of Most Recent Payment on Claim

    185(l) Date Closed

    188(m) Number of AOBs?

    192(n) Date Earliest AOB was Executed

    198(o) Date Earliest AOB was Reported to Insurer

    206(p) Assignee’s Presuit Settlement Demand

    211(q) Insurer’s Presuit Settlement Offer

    216(r) Judgment Obtained by Assignee

    221(s) Litigation on Claim (Y/N)

    226(t) Reasonable Attorney Fees Awarded Under Section 233627.7152(10), F.S. 235to the Insurer
