69V-560.913. Termination of Deferred Presentment Activity and Transaction Maintenance

  • 1(1) Within fifteen (15) business days after ceasing operations or no longer holding a license under Part II or Part III of Chapter 560, F.S., a deferred presentment provider must provide notification to the Office of such action. The notice must be in writing, signed by the deferred presentment provider, and include the following:

    55(a) The date the deferred presentment provider ceased deferred presentment activity;

    66(b) A listing of all open and pending transactions including the drawer’s name, transaction number, transaction amount, and transaction date;

    86(c) Licensee’s name, license number, and mailing address; and,

    95(d) Contact person’s name, email address, and phone number.

    104(2) The notification required in subsection (1) above must be mailed to Office of Financial Regulation, Attention: Deferred Presentment Database Contract Manager, 200 East Gaines Street, Tallahassee, Florida 32399-0376, or transmitted by facsimile to (850)410-9914.

    139(3) For purposes of this section, the term “ceasing operations” shall mean that the provider has closed its offices to the public or has removed public access to its website, if such access is the sole means of communication with its customers. This provision shall not apply if a provider has given its customers a reasonable alternative for communications and payments.

    200(4) If the notice required in this section is not timely received, the Office of Financial Regulation shall administratively close all open and pending transactions.

    225(5) Transactions that are administratively closed by the Office of Financial Regulation shall not be reopened.
