1(1) The funds allocated to each county shall be offered first to an existing Weatherization Assistance Program provider in good standing that can provide services to the target population consisting of low-income persons, low-income elderly persons, and low-income physically disabled persons.
42(2) If an existing Weatherization Assistance Program provider is not in good standing, as determined by the department, the department shall notify the WAP provider by certified mail of the department’s intentions to offer the funds to the local government or another non-profit corporation. The department will specify the outstanding issues leading to the determination that the WAP agency is not in good standing. The WAP agency will be given 21 days in which to respond to the concerns of the department or to request an appeal under Chapter 120, F.S. If no response is received within the 21 day period, the department will proceed with offering the funding to the appropriate local government.
156(3) If a Weatherization Assistance Program grantee is not available to serve the entire county area, the funds shall be distributed through the following process:
181(a) An announcement of funding availability shall be provided to the county. The county may elect to administer the program.
201(b) If the county elects not to administer the program, the department will offer the funding to a qualified existing FloridaFix grantee in good standing that can provide services to the target population in the specified county.
238(c) If no qualified FloridaFix grantee is available to serve the entire county area, the department will distribute the funds through the following process:
2621. The department will publish a notice of the availability of funds, application deadline and selection criteria in the Florida Administrative Weekly.
2842. The department will select a non-profit corporation based on the following:
296a. Past experience and performance in weatherization or housing renovation or rehabilitation activities;
309b. Experience in assisting low-income persons in the geographic area to be served;
322c. Capacity to undertake a timely and effective program;
331d. Capacity to develop and use community resources to provide the required match; and
345e. Standing with the department.
350(d) If no eligible agency agrees to serve a county, the funds allotted for that county shall be re-distributed at the discretion of the department to other existing grantees.
379(4) At the end of the contract year, any funds not expended by the grantee shall be returned to the Economic Opportunity Trust Fund and reallocated under the subsequent year’s funding cycle as part of the total funds available for all grantees.
