In addition, new techniques and approaches have been developed to support RBCA, but the rule chapter is silent, ambiguous or implicitly prohibits these advancements. Finally, a number of inconsistencies or incongruities have been uncovered within the rule chapter, and these will be corrected.

This rule making is planned to run concurrently with rule making for Chapter 62-777, F.A.C. "Contaminated Site Cleanup Criteria".

The purpose and effect of initiating rulemaking will be to begin the necessary dialogue among various interested stakeholders to discuss proposed amendments to the rules governing the Risk-Based Corrective Action (RBCA) process at contaminated sites in Florida. Further, amendments are needed to conform Ch. 62-780 to the procedures being developed simultaneously in Ch. 62-771 and Ch. 62-772, F.A.C., for state funded cleanup of petroleum contaminated sites.
Published on: 12524851. The purpose of this workshop is to discuss proposed amendments to the rules governing the Risk-Based Corrective Action (RBCA) process at contaminated sites in Florida. These proposed amendments were drafted in response to a Petition to Initiate Rulemaking on Chapters 62-780 and 62-777, F.A.C., filed by Associated Industries of Florida (AIF) pursuant to Section 120.54(7), F.S.
The proposed revisions to Chapter 62-780, F.A.C., clarify that the “Referenced Guidelines” are guidance and not enforceable, add a hierarchy of information sources for reference when developing alternative cleanup target levels, specify the information needed when performing a probabilistic risk assessment and establish criteria for supporting a Site Rehabilitation Completion Order based on alternative cleanup target levels, but without institutional or engineering controls.

The purpose and effect is to achieve rule consolidation and consistency across these contaminated site cleanup programs, where possible, based on governing statutes. Concurrently, the Department is proposing to repeal Chapters 62-770, 62-782 and 62-785, F.A.C. The rule repeals are in support of the Governor’s Executive Order #11-01 (and subsequent Executive Orders 11-72 and 11-211).
