232Whether the Loxahatchee River Environmental Control

238District's applications for construction of wastewater collection

245and transmission systems, specifically, Permit Numbers

251CS50-298013, CS50-301197, and CS50-305990, should be granted by

259the Palm Beach County Health Department.

265PRELIMINARY STATEMENT

267On December 17, 1996, Respondent, Palm Beach County Health

276Department (Health Department), issued Permit No. CS50-298013 to

284Respondent, Loxahatchee River Environmental Control District

290(ENCON) for construction of sewers in Bermuda Terrace and

299Pinetree Drive, immediately adjacent to the Village of Tequesta

308(Tequesta). Bermuda Terrace and Pinetree Concerned Citizens

315(Concerned Citizens) and the Village of Tequesta filed petitions

324on December 30, 1996, challenging the proposed permit.

332On March 27, 1997, the Health Department issued a Notice of

343Intent to Issue Permit No. CS50-305990 to ENCON for the

353construction of sewers in Country Club Point and Anchorage Point,

363located in the Village of Tequesta. On April 9, 1997, Tequesta

374filed a petition challenging the notice of intent to issue.

384On June 24, 1997, the Health Department issued a Notice of

395Intent to Issue Permit No. CS50-305990 for the construction of

405sewers in Tequesta Country Club. On July 7, 1998, Tequesta filed

416a petition challenging the notice of intent to issue.

425The cases were referred to the Division of Administrative

434Hearings for assignment to an administrative law judge. On

443February 25 and March 10, 1997, motions to dismiss were filed by

455Respondents, but were denied by Order dated April 16, 1997. The

466Order clarified the issues of the hearing as follows: "Whether

476the particular system proposed by ENCON should be permitted, not

486whether ENCON's decision to replace septic tanks with a sewer

496system was a sound decision or whether ENCON followed its own

507rules in deciding whether to install the sewer system." By order

518issued June 3, 1997, the cases were consolidated for final

528hearing.

529On June 23, 1997, Circuit Court Judge Moses Baker granted

539Petitioners' Motion to Stay Final Hearing, and on July 22, 1997,

550the undersigned Administrative Law Judge granted an Order to Stay

560the Final Hearing, which had been scheduled for July 28-31, 1997.

571On or about October 22, 1997, the stay was lifted by the Circuit

584Court of Palm Beach County, and on December 18, 1997, a Notice of

597Hearing was issued scheduling the final hearing for January 21,

6071998.

608At the final hearing, the Health Department called Robert

617Mitchell and Umesh Asrani as its witnesses. Health Department's

626Exhibits 1-3 were admitted in evidence. ENCON did not call any

637witnesses and did not submit any exhibits. Petitioners called

646the following witnesses: William Reece, James Macon, Thomas

654Bradford, Vince Amy, John Dreith, Thomas Little, Terrance

662Bengtsson and Michael Walters. Petitioners' Exhibits 1-4 and 7

671were admitted in evidence. Petitioner proffered two exhibits.

679At the final hearing, the parties agreed to file Proposed

689Recommended Orders within 20 days of the filing of the

699transcript. The transcript was filed on February 26, 1998.

708Respondent ENCON filed its proposed recommended order on

716March 16, 1998. The Health Department did not file a proposed

727recommended order. Petitioners filed their Proposed Recommended

734Order on March 18, 1998.

739FINDINGS OF FACT

7421. Respondent, Palm Beach County Health Department (Health

750Department) was delegated the authority by the Department of

759Environmental Protection to review applications and issue permits

767for wastewater collection and transmission systems pursuant to

775the Specific Operating Agreement for Delegation of Wastewater

783Program Authority From the Florida Department of Environmental

791Protection. The argument specifically referenced Chapter 403,

798Florida Statutes, and the successor to Title 17, Florida

807Administrative Code, which is Title 62.

8132. Respondent, Loxahatchee River Environmental Control

819District (ENCON), is a water control district.

8263. Petitioner, Village of Tequesta ( Tequesta), is a

835municipal corporation.

8374. Petitioner Bermuda Terrace & Pinetree Drive Concerned

845Citizens (Concerned Citizens) is a coalition of homeowners of

854record owning property in Bermuda Terrace and on Pinetree Drive.

8645. On December 17, 1996, the Health Department issued

873Permit No. CS50-298013 to ENCON for installation of sewers in

883Bermuda Terrace and Pinetree Drive.

8886. On March 27, 1997, the Health Department issued a Notice

899of Intent to Issue Permit No. CS50-301197 to ENCON for the

910construction of sewers in Country Club Point and Anchorage Point.

9207. On June 24, 1997, the Health Department issued a Notice

931of Intent to Issue Permit No. CS50-305990 to ENCON for the

942construction of sewers in Tequesta Country Club.

9498. Currently the wastewater in the areas for which the

959sewers are proposed to be installed flows into septic tank

969systems. There are 835 homes on the Tequesta Peninsula that

979would be hooking up to the proposed sewer system.

9889. The Health Department created a review form for internal

998use in reviewing applications for sewage collection permits. The

1007Sewage Collection Checklist contains the statutory and

1014administrative rule requirements for permitting sewage collection

1021and transmission systems. The applications submitted by ENCON

1029were reviewed using the review form. All three applications met

1039the criteria contained in the applicable statutes and rules.

104811. Robert Mitchell, who supervises the permitting for

1056wastewater collection systems for the Health Department, opined

1064that the permit applications provided reasonable assurances that

1072the construction and operation of the sewage system would not

1082discharge, emit, or cause pollution. A sewage collection system

1091does not emit or discharge pollution and, if constructed and

1101functioning according to the technical requirements of the

1109administrative rules, does not cause pollution. Thus, the

1117applications compliance with the technical compliance with Rules

112562-604.400 and 62-604.300, Florida Administrative Code, is

1132reasonable assurance that the proposed systems will not cause

1141pollution.

114212 The proposed permits contain the following specific

1150condition:

1151Prior to construction, all required permits

1157or approvals must be obtained for all

1164aspects of the project from the appropriate

1171agencies.

117213. Any dewatering required by the construction of the

1181wastewater collection/transmission system will have to meet the

1189permitting criteria for that particular activity, which comes

1197under the jurisdiction of the South Florida Water Management

1206District and not the Health Department.

1212CONCLUSIONS OF LAW

121514. The Division of Administrative Hearings has

1222jurisdiction over the parties to and the subject matter of these

1233proceedings. Section 120.57(1), Florida Statutes.

123815. Review and issuance of wastewater collection and

1246transmission systems is governed by Section 403.007, Florida

1254Statutes and Chapter 62-604, Florida Administrative Code.

126116. Rule 62-604.100(7), Florida Administrative Code

1267provides:

1268The purpose of Chapter 62-604, F.A.C., is to

1276provide minimum design and operation and

1282maintenance standards for domestic wastewater

1287collection/transmission systems. Systems

1290shall be designed in accordance with sound

1297engineering practice. Supported by

1301moderating provisions, it is intended that

1307Chapter 62-604, F.A.C., establish a framework

1313whereby design flexibility and sound

1318engineering practice can be used in

1324developing systems with which to collect and

1331transport domestic wastewater in an

1336environmentally sound manner.

133917. Rule 62-604.300, Florida Administrative Code, sets

1346forth the general technical criteria and standards for

1354construction of collection and transmission systems contained in

1362standard manuals and publications which are incorporated by

1370reference.

137118. Rule 62-604.400, Florida Administrative Code, contains

1378the design/performance consideration for the review of

1385applications for permits for collection and transmission systems.

139319. Rule 62.604.300(7), Florida Administrative Code,

1399states: "Permitting requirements and fees related to permitting

1407are listed in Chapter 62-4, F.A.C."

141320. Rule 62-4.070(1), Florida Administrative Code, states:

1420(1) A permit shall be issued to the

1428applicant upon such conditions as the

1434Department may direct, only if the applicant

1441affirmatively provides the Department with

1446reasonable assurance based on plans, test

1452results, installation of pollution control

1457equipment, or other information that the

1463construction, expansion, modification,

1466operation, or activity of the installation

1472will not discharge, emit, or cause pollution

1479in contravention of Department standards or

1485rules. However, for discharges of wastes to

1492water, the Department may issue temporary

1498operation permits under the criteria set

1504forth in Section 403.088(3), F.S.

150921. ENCON's three applications met the technical standards

1517in Rules 62-604.300 and 62-604.400, Florida Administrative Code.

1525ENCON has provided reasonable assurance that the proposed

1533wastewater collection and transmission systems will not emit,

1541discharge or cause pollution.

154522. Petitioners argue that the construction of the systems

1554will require dewatering and ENCON has not explained what it will

1565do with the water, such as treating the water prior to discharge

1577or tankering the water off site. Dewatering would come under the

1588jurisdiction of the South Florida Water Management District and

1597any permit for dewatering activities would be issued by the South

1608Florida Water Management District. If a permit is necessary for

1618dewatering, a specific condition of the permits at issue requires

1628ENCON to get all necessary permits prior to construction,

1637including a permit for dewatering.

164223. Petitioners do not argue that the plans for the

1652wastewater collection and transmission systems do not meet the

1661technical requirements of Rules 62-604.300 and 62-604.400,

1668Florida Administrative Code. They argue that homeowners who are

1677currently using septic tank systems will be required to connect

1687to the sewer system and discontinue use of the septic tanks,

1698which will result in reduced recharge to the aquifer and an

1709imbalance in the saltwater/freshwater interface causing saltwater

1716intrusion to water supply wells. Petitioners cite Save the

1725Manatee, Inc. & Friends of the Greenway v. Citrus Recreational

1735Marina, Inc., & Florida Department of Environmental Protection ,

1743DOAH Case No. 96-1723 ,(DEP, February 5, 1997); Florida Power v.

1754DER , 605 So. 2d 149 (Fla. 1st DCA 1992); and The Conservancy,

1766Inc., v. A. Vernon Allen Builder , 580 So. 2d 772 (Fla. 1st DCA

17791991) for the proposition that the Health Department should

1788consider whether the discontinuance of the use of septic tanks

1798will cause salt water intrusion to the water supply wells. The

1809cases cited deal with dredge and fill permits and not permits

1820issued pursuant to Section 403.007, Florida Statutes.

1827RECOMMENDATION

1828Based on the foregoing Findings of Fact and Conclusions of

1838Law, it is RECOMMENDED that a Final Order be entered granting

1849Permit Nos. CS50-301197, CS50-305990, and CS50-298013 to ENCON

1857for construction of sewer systems.
