113Whether Respondent Employer is guilty of an unlawful
121employment practice by termination of Petitioner on the basis of

133PRELIMINARY STATEMENT
135This case appears before the Division of Administrative
143Hearings upon remand, on or about February 23, 2001, from the
154Florida Commission on Human Relations .
160On December 13, 2001, Petitioner did not appear for a duly -
172noticed disputed - fact hearing on the merits of her Petition for
184Relief, and Res pondent moved for dismissal.
191Beyond the foregoing introduction, the procedural matters of
199this cause are addressed in the following Findings of Fact and
210Conclusions of Law.
213FINDINGS OF FACT
2161. This cause was initially referred to the Division of
226Admin istrative Hearings on or about August 14, 2000, following
236investigation and a "Determination: No Cause" by the Florida
245Commission on Human Relations .
2502. Also on August 14, 2000, the Division of Administrative
260Hearings issued its Initial Order. On August 16, 2000,
269Respondent filed a response thereto. Petitioner never responded.
2773. On August 30, 2000, Respondent filed a Motion to
287Dismiss, based on the untimeliness of the Petition for Relief.
297Petitioner did not timely file a response in opposition to the
308Motion, pursuant to Rule 28 - 106.204, Florida Administrative Code
318(formerly Rule 60Q - 2.016, Florida Administrative Code).
3264. On September 27, 2000, the undersigned issued an Order
336taking the Motion to Dismiss under advisement and granting ten
346additional days beyond the time provided by rule in which
356Petitioner would be allowed to file any written response in
366opposition to the pending Motion to Dismiss.
3735. Petitioner did not file any response in opposition to
383the Motion to Dismiss under the terms of th e September 27, 2000,
396Order.
3976. On October 20, 2000, a Recommended Order was issued,
407dismissing the Petition.
4107. On February 8, 2001, the Florida Commission on Human
420Relations entered an Order re - interpreting its rules and
430departing from the long line of cases upon which the October 20,
4422000, Recommended Order had been based. The Commission's Order
451remanded the cause to the Division for a hearing on the merits. 1
4648. On February 27, 2001, the Clerk of the Division of
475Administrative Hearings reopened t he case. Also on February 27,
4852001, a Notice of Hearing was entered scheduling the disputed -
496fact hearing on the merits for March 20, 2001.
5059. On March 16, 2001, a Notice of Automatic Stay was filed.
517The cause was stayed before the Division pending rev iew of the
529Commission's Order of Remand by the First District Court of
539Appeal. 2
54110. By an Order dated August 16, 2001, the First District
552Court of Appeal denied Respondent's Petition for Writ of
561Prohibition or Quo Warranto, and, in effect, upheld the
570Co mmission's remand, thereby concluding the automatic stay of
579proceedings before the Division. 3
58411. On August 30, 2001, Respondent filed a Motion to Compel
595answers to its interrogatories and for Petitioner to be deposed.
605Respondent's Motion also requested that sanctions be imposed
613against Petitioner for her non - appearance at her deposition which
624had been duly - noticed for October 18, 2000, prior to the
636Recommended Order of Dismissal. The Motion was accompanied by a
646supporting affidavit by a court reporter documenting and
654attesting to Petitioner's non - appearance for her deposition.
66312. Petitioner filed no timely response in opposition to
672the motion to compel and for sanctions.
67913. On September 14, 2001, the undersigned entered an Order
689requiring Petiti oner to file a response to the Motion within an
701additional ten days. Petitioner again failed to respond to the
711Motion to Compel.
71414. By an Order and Notice of Hearing entered October 5,
7252001, the Motion to Compel was granted in part and denied in
737part. Petitioner was ordered to appear for her deposition to be
748re - scheduled by Respondent in Petitioner's county of residence,
758at a mutually convenient date and time if Petitioner would
768specify a convenient date and time. If Petitioner would not
778specify a da te and time, the deposition was to be scheduled by
791Respondent in Petitioner's county of residence on at least ten
801days' notice. Any issue as to sanctions was deferred until the
812commencement of the hearing on the merits, which was rescheduled
822for December 13, 2001, when, presumably, Petitioner would be
831present and able to orally present any opposition.
83915. An Order of Pre - hearing Instructions was also entered
850and mailed on October 5, 2001.
85616. On December 4, 2001, Respondent filed a Motion for
866Continua nce and for Dismissal of the Petition for Relief due to
878Petitioner's failure, yet again, to appear for her duly - noticed
889deposition on November 30, 2001. A court reporter's affidavit
898was again attached. Petitioner did not respond thereto.
90617. On Decem ber 11, 2001, Respondent filed a Unilateral
916Pre - hearing Statement in accord with the Order of Pre - hearing
929Instructions. Petitioner failed to comply with the Order of
938Pre - hearing Instructions, even to the extent of stating her
949position or listing the witn esses she intended to call at the
961hearing on the merits.
96518. On December 13, 2001, at the time and place appointed
976for final hearing on the merits, Petitioner did not appear.
98619. A court reporter provided by, and at the expense of,
997the Commission app eared. Counsel for Respondent and Respondent's
1006principal agent appeared. The Division incurred the expense of
1015the undersigned's travel to Petitioner's and Respondent's county
1023of residence where the hearing was scheduled. Respondent
1031incurred the cost of its attorney's travel.
103820. All concerned waited half - an - hour and Petitioner did
1050not appear.
105221. The undersigned then inquired of Respondent's counsel
1060if any items he had mailed to Petitioner had been returned to him
1073by the United States Postal Service . He indicated on the record
1085that none had been returned to him and that Petitioner had never
1097communicated with him.
110022. No Order or Notice sent by the Division to Petitioner
1111has been returned to the Division by the United States Postal
1122Service.
112323. T he presumption, therefore, is that Petitioner has
1132received all pleadings and papers served by Respondent's counsel
1141and has received all Orders and Notices issued by the Division of
1153Administrative Hearings. Accordingly, it can only be concluded
1161that Petiti oner has willfully disregarded the Order and Notices
1171of this forum.
117424. Respondent's counsel filed, in open court, an Affidavit
1183addressing attorney's fees and costs incurred by Respondent as a
1193result of defending this case in the face of Petitioner's will ful
1205refusal to comply with Respondent's legitimate discovery requests
1213and Orders of this forum. Respondent moved orally for an
1223assessment of said costs and attorney's fees against Petitioner.
1232That matter has been addressed by an interlocutory order.
124125 . After waiting a total of 45 minutes, Petitioner still
1252had not appeared.
125526. The final merits hearing was adjourned and its record
1265closed without Petitioner presenting any evidence in support of
1274her charge of discrimination or her Petition for Relief from an
1285unlawful employment practice.
1288CONCLUSIONS OF LAW
129127. The Division of Administrative Hearings has jurisdiction
1299over the parties and subject matter of this cause, pursuant to
1310Section 120.57(1), Chapter 760, Florida Statutes, and the
1318Commission rema nd.
132128. Petitioner's failure to appear and put on evidence
1330means that she has failed to carry her duty to go forward and her
1344burden of proof by a preponderance of the evidence to establish
1355that an unlawful employment practice has been committed against
1364her by Respondent Employer, pursuant to Section 760.10, Florida
1373Statutes.
137429. The fact that Petitioner has failed to prevail upon the
1385merits makes it unnecessary to rule upon any of Respondent's
1395pending Motions to Dismiss.
1399RECOMMENDATION
1400Upon the fore going Findings of Fact and Conclusions of Law,
1411it is
1413RECOMMENDED
1414That the Florida Commission on Human Relations enter a final
1424order dismissing the Petition for Relief herein.
