112STATEMENT OF THE ISSUE

116The issue is whether Petitioners are entitled to an

125after-the-fact permit from Respondent for the garage and storage

134building erected by Petitioners within the floodway of the

143Suwannee River.

145PRELIMINARY STATEMENT

147On April 2, 1999, Petitioners filed an application for a

157boat ramp with Respondent, Suwannee River Water Management

165District (District). That permit was ultimately granted. In

173April of 1999, personnel employed by Respondent went to the site

184and observed there was no garage and storage structure built on

195the lot. A copy of Respondent's rules was provided to

205Petitioners.

206In 1999, Petitioners started and completed a garage and

215storage structure on their lot on the Suwannee River. They

225received a Notice of Violation dated April 18, 2000.

234On June 19, 2000, Petitioners prepared a Notice of Intent

244to construct a surface water management system, which was

253received by Respondent on July 3, 2000. Respondent did not send

264a denial in response to this Notice, electing instead to

274institute a timely action in the circuit court pursuant to

284authority contained in Chapter 373, Florida Statutes.

291At the final hearing, Petitioner, Wayne Duke, Sr.,

299testified on his own behalf and presented the testimony of two

310witnesses. Petitioner also offered ten exhibits which were

318accepted into evidence. Respondent presented the testimony of

326three witnesses and 11 exhibits. No transcript of the final

336hearing was ordered. Both parties have submitted Proposed

344Recommended Orders. Those Proposed Recommended Orders have been

352reviewed and utilized in the preparation of this Recommended

361Order.

362FINDINGS OF FACT

3651. Petitioners are the owners of real property located at

375Lot 15, Suwannee Bluffs as per Plat Book 4, page 18 of the

388public records of Lafayette County, Florida.

3942. Respondent, Suwannee River Water Management District,

401is an agency of the State of Florida with a responsibility for

413surface water management within the District.

4193. Petitioners live in a home on their Suwannee River

429property and, in 1999, completed a garage and storage structure

439on the property without obtaining a permit for construction of

449the structure. The structure measures 35 feet by 50 feet. It

460is a concrete block structure on a concrete slab with a metal

472roof. There are three doors on one side of the structure. The

484remainder of the structure is enclosed.

4904. On or about March 31, 1999, Petitioners, prior to

500construction of the garage and storage structure, applied for an

510environmental resource permit for a boat ramp, which permit was

520subsequently granted.

5225. The entire lot of Petitioners is within the floodway of

533the Suwannee River. The floodway is defined as a work of

544Respondent's district in Rule 40B -4.3000, Florida Administrative

552Code.

5536. The Suwannee River flows within the boundaries of the

563Suwannee River Management District.

5677. On or about April 18, 2000, Notice of Violation was

578sent to Petitioners by Respondent.

5838. On or about June 19, 2000, Petitioners executed a

593Notice of Intention to construct a surface water management

602system for the already completed garage structure. Basically,

610the surface water management system envisioned by Petitioners

618would have consisted of modifications to the already completed

627garage to permit flood waters to flow through the structure.

637Respondent did not send any responsive formal notice of denial

647to Petitioners regarding such proposed intention. Instead,

654Respondent filed a lawsuit in July of 2000, within the 90-day

665period required by Section 120.60(1), Florida Statutes, in

673circuit court against Petitioners to prevent the construction of

682the system. Such action by Respondent constituted denial of

691Petitioners' requested action.

6949. Petitioners' garage construction was in violation of

702Ordinance 1 -87 of Lafayette Cou nty, Florida, and in fact,

713Petitioners received a Notice of Violation from Lafayette

721County, Florida, dated December 9, 1999, which has still not

731been resolved.

73310. Rule 40B -4.3040, Florida Administrative Code,

740prohibits the placing of a structure in the works of a District

752without a works of the District development permit.

760Petitioners' garage structure was not permitted and was in

769violation of the rules of the District in force and effect at

781the time of its construction, notwithstanding Respondent's

788informal delegation of enforcement of those rules to local

797county governments in Respondent's district prior to July 1999.

80611. Rule 40B -4.3030 Florida Administrative Code,

813proscribes the issuance of a works of the District's development

823permit for any work structures, road, or other facilities which

833have the potential of individually or cumulatively reducing

841floodway conveyance or increasing water surface elevations above

849the 100-year flood elevation or increasing soil erosion.

857Testimony of two experts offered by Respondent at the final

867hearing establishes that the structure in question will

875cumulatively reduce floodway conveyance and increase water

882surface elevations above the 100 year flood elevations and

891potentially increase soil erosion. Adverse impacts to the

899public interest include the following:

904(a ) increased flood levels;

909(b ) increased scouring by debris and

916erosion; and

918(c ) increased water surface elevations

924above the 100 year flood elevation.

93012. The cumulative impact of allowing Petitioners'

937structure and other structures would magnify the problems of

946increased erosion, debris damage, and floodway conveyance. The

954cumulative impact from such construction along the water could

963have significant cumulative adverse impact on the waters of the

973State of Florida and specifically, the Suwannee River.

981CONCLUSIONS OF LAW

98413. The Division of Administrative Hearings has

991jurisdiction over the subject matter. Section 120.57(1) and

999Section 120.569, Florida Statutes.

100314. The burden of proof, absent a statutory directive to

1013the contrary, is on the party seeking the affirmative of the

1024issue of the proceeding. Department of Transportation v. J.W.C.

1033Co., Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981).

104315. In this proceeding, Petitioners have the ultimate

1051burden of proof and have failed to meet this burden.

1061Petitioners' contend that the failure of Respondent to issue a

1071specific denial to them with regard to their application to

1081construct a surface water management system consisting of

1089modifications to the unpermitted garage structure resulted in

1097granting of permission to Petitioners by default pursuant to

1106Section 120.60, Florida Statutes. Such contention is not

1114persuasive. Respondent's disapproval was adequately

1119communicated to Petitioners via the circuit court action

1127instituted to prevent Petitioners' project.

113216. Petitioners failed to establish they were not in

1141violation at the time of application for an Environmental

1150Resource Permit (ERP) and that they did apply for an ERP.

1161Further, Respondent's permitting process requires Petitioners to

1168prove that the subject structure would not have the potential of

1179individually or cumulatively reducing floodway conveyance or

1186increasing water surface elevation above the 100-year flood

1194elevation or increasing soil erosion. This Petitioners failed

1202to do.

120417. The property of Petitioners is within the floodway of

1214the Suwannee River and, therefore, a work of the District. A

1225works of the development district permit would be required for

1235construction of the building at hand which has never been

1245issued. The structure is in violation of Rule 40B -4.3040,

1255Florida Administrative Code.

1258RECOMMENDATION

1259Based on the foregoing Findings of Fact and Conclusions of

1269Law, it is

1272RECOMMENDED that the Suwannee River Water Management

1279District enter a Final Order dismissing the petition in this

1289case and denying the issuance of an after-the-fact works of the

1300District permit to Petitioners.
