89STATEMENT OF THE ISSUE

93The issue in the case is whether the allegations set forth

104in the Administrative Complaint filed against the Respondent are

113correct and, if so, what penalty should be imposed.

122PRELIMINARY STATEMENT

124On January 24, 2001, the Department of Health, Board of

134Nursing (Petitioner) filed an Administrative Complaint against

141Beverly Cooper (Respondent) alleging that while working at a

150nursing home, the Respondent struck a resident at the facility

160with a closed fist. The Respondent filed a request for formal

171hearing. The request was forwarded to the Division of

180Administrative Hearings, which scheduled the proceeding.

186During the hearing, the Petitioner presented the testimony

194of four witnesses and had Exhibits numbered 1-4 admitted into

204evidence. The Respondent did not attend the hearing.

212A Transcript of the hearing was filed on July 11, 2001.

223The Petitioner filed a Proposed Recommended Order that was

232considered in the preparation of this Recommended Order.

240FINDINGS OF FACT

2431. The Petitioner is the state agency charged with the

253responsibility for regulation and discipline of nursing practice

261within the State of Florida.

2662. The Respondent is a registered nurse holding Florida

275license number 2551692.

2783. On June 1, 2000, the Respondent was employed as a

289registered nurse at Harborside Healthcare Nursing Home.

2964. The Respondent was assigned to provide patient care

305including administration of medications to residents.

3115. L. M. was a resident of Harborside Healthcare. L. M.

322was a diabetic and required insulin injection as a part of her

334treatment for the diabetes.

3386. On June 1, 2000, the Respondent attempted to administer

348an insulin injection to L. M. Two Certified Nursing Assistants

358were present in L. M.'s room at the time of the injection.

3707. When the Respondent began the injection, L. M. "jumped"

380or "jerked," and the Respondent struck L. M.'s arm with the

391Respondent's closed fist.

3948. Both of the nursing assistants reported the incident to

404the facility's Director of Nursing. The Director of Nursing

413investigated the incident and discussed it with the Respondent,

422who initially admitted the striking although she later denied

431the event.

4339. The Respondent was immediately suspended from her

441employment and was subsequently terminated.

44610. Minimal standards of professional nursing practice

453prohibit the striking of a patient.

459CONCLUSIONS OF LAW

46211. The Division of Administrative Hearings has

469jurisdiction over the parties to and subject matter of this

479proceeding. Section 120.57(1), Florida Statutes.

48412. The Petitioner has the burden of proving by clear and

495convincing evidence the allegations against the Respondent.

502Ferris v. Turlington, 510 So. 2d 292 (Fla. 1987). In this case,

514the burden has been met.

51913. The evidence establishes that on June 1, 2000, the

529Respondent struck a patient under her care. There was no

539evidence presented which could offer an explanation or

547justification for the Respondent's action.

55214. Section 464.018, Florida Statutes, sets forth the

560grounds for disciplinary action by the Board of Nursing against

570a licensed registered nurse.

57415. Section 464.018(1)(h), Florida Statutes, prohibits

"580[u ]nprofessional conduct, which shall include, but not be

589limited to, any departure from, or the failure to conform to,

600the minimal standards of acceptable and prevailing nursing

608practice, in which case actual injury need not be established."

61816. Rule 64B9-8.005(13), Florida Administrative Code,

624prohibits "[f ]ailure to conform to the minimal standards of

634acceptable prevailing nursing practice, regardless of whether or

642not actual injury to a patient was sustained."

65017. In striking the patient, the Respondent departed from

659minimal standards of acceptable and prevailing nursing practice.

66718. Rule 64B9-8.006, Florida Administrative Code, provides

674guidelines for the determination of appropriate discipline

681imposed upon a violation of the disciplinary statute.

68919. For a violation of Section 464.018(1)(h), Florida

697Statutes, the rule provides a penalty range from reprimand to

707suspension until proof of safety to practice, followed by

716probation with conditions and appropriate continuing education

723courses, and an administrative fine of $250 to $1,000.

733RECOMMENDATION

734Based on the foregoing Findings of Fact and Conclusions of

744Law, it is recommended that the Department of Health, Board of

755Nursing, enter a Final Order imposing an administrative fine of

765$1,000, and suspending the Respondent's licensure until such time

775as the Respondent provides to the Board proof of her ability to

787practice nursing safely, after which the Respondent shall be

796placed on probation for a one-year period under such conditions

806as the Board deems appropriate.
